RESOLUTION NO. 199 0~
RESOLUTION AUTHORIZING THE MAYOR OR HIS DULY AUTHORIZED
REPRESENTATIVE TO NEGOTIATE AND TO EXECUTE NECESSARY DOCUMENTS
WITH FAIRYTALE AT KAHALU~U BEACH, INC., TO SATISFY CONDITION "I"
OF ORDINANCE N0. 00-103.
WHEREAS, Fairytale at Kahalu~u Beach, Inc. (Fairytale) is
the owner of approximately 32,205 square feet of land at
Kahalu'u, North Kona, Hawai i, covered by tax map key
(3) 7-8-14: 90; and
WHEREAS, on September 18, 2000, Change of Zone Ordinance
No. 00-103 became effective, which reclassified lands from
single-family residential (RS-7.5) to multi-family residential
(RM-1); and
WHEREAS, Condition "I" of Change of Zone Ordinance
No. 00-103 requires compliance with the requirements of
Chapter 11, Article 1, Hawaii County Code, relating to
Affordable Housing; and
WHEREAS, residents of West Hawaii cannot find affordable
housing units to purchase or to rent; and
WHEREAS, pursuant to Chapter 11, Section 11-4 (c) of the
Hawaii County Code, the Hawaii County Housing Agency has
adopted HCHA Resolution No. 137, directing that Fairytale at
Kahalu'u Beach, Inc., satisfy Condition "I" by producing
affordable housing.
NOW, THEREFORE, BE IT RESOLVED BY THE HAWAII COUNTY
COUNCIL that the Mayor or his duly authorized representative is
authorized to negotiate with Fairytale at Kahalu~u Beach, Inc.,
and to execute necessary documents to satisfy Condition "I" of
Ordinance No. 00-103 in accordance with Hawaii County Housing
Agency Resolution 137, Draft 3.
BE IT FURTHER RESOLVED, that this resolution shall take
effect immediately.
