Re: Dedication Deed -Towne Keauhou LLC, a Hawaii limited liability company
TMKs (3) 7-7-25-56 (Res No. 196-041 and 7-7-26-26 ~Res.No. 195-04)
Following discussion at the June 14, 2004, Council Committee on Public Works and
Intergovernmental Relations meeting, the resolutions for the dedication of real properties from
Towne Keauhou LLC, were revised, and are enclosed for your consideration. The changes are:
1) Insertion of two WHEREAS clauses as follows:
WHEREAS, Section 23-10 ofthe Hawaii County Code prohibits
the Council from receiving by dedication any streets in any subdivision
platted after December 2, 1966 except upon full compliance with the
provisions of Chapter 23; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County
Charter provides that the Council, on behalf of the County of Hawaii,
may accept gifts which include the dedication of land on behalf
of the County of Hawaii.
2) Inspection and approval letters from the Engineering Division dated January 21,
2004, and the Traffic Division dated March 10, 2004.
