HomeMy WebLinkAboutRES 210 Draft 01 2002-2004 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 210 04 RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF HEALTH, PURSUANT TO HRS 46-7, FOR AN AUTOMATED EXTERNAL DEFIBRILLATOR ACCESS PROGRAM GRANT WHEREAS, the State of Hawaii Department of Health, Emergency Medical Services System, as lead agency, was awarded a grant from the Federal Office of Rural Health Policy's Rural Access to Emergency Devices Grant Program for Hawaii and South Pacific Territories; and WHEREAS, the State of Hawaii Department of Health, Emergency Medical Services System has authorized funding to the Hawaii County Fire Department for its Automated External Defibrillator (AED) Access Program in Hawaii County; WHEREAS, the Hawaii County Fire Department will use the funds to establish a community AED advisory committee; coordinate AED training with the American Heart Association; purchase 17 to 20 AED's for placement with identified agencies; and assist AED agencies with medical protocols; and WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. NO~P11, THEREIFORE, RE IT RESOLVED ~Y THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the County of Hawaii is authorized to execute, on behalf of the County, a memorandum of agreement with the State of Hawaii Department of Health, attached hereto and incorporated herein by reference as Exhibit "A" to enable the County to implement the Automated External Defibrillator Access Program. BE IT FURTHER RESOLVED that the Mayor of the County of Hawaii is authorized to sign the above-referenced agreement and any related documents on behalf of the Office of the Mayor and the County of Hawaii pursuant to the Hawaii County Charter. BE iT FURTHER RESOLVED that the County Clerk of the County of Hawaii shall transmit copies of this resolution to the Hawaii County Fire Department and the Finance Department. Esffiblish a community AED advisory committee comprised of public and private agencies to plan, identify, the placement of AED's to optimize the response to persons who had a sudden cardiac an•est. 2. Coordinate the AED training with the American Heart Association for idcnfified individuals responsible for an agencies AED program. 3. purchase 17-20 AED's for placement in agencies identified. 4. Assist AED agencies with the development of protocols for physician oversight of. training and maintenance of the AED. 5. Submit s written report within 30 day to include the name of the agencies assigned an AED, the number of persons trained, and the mmtber of AED's purchased together with copy of the AED delivery invoice. The satisfactory completion of this MOA will be the submission of a final report to the CHIEF delineating the completion of the scope of work outlined above. DOH REF. NO. ' 1. Establi§hment of community AED advisory committee to be completed by June 15, 2004. Report to be submitted to STATE by June 30, 2004. ' 2. Americar7, Heart Association training to be cotnpleted'by, June 30, 2004. Report on , training to be submitted to STATE by June 30, 2004. 3. Purchase of AEDs to be completed by June 30, 2004. 4. STATE agrees, subject to allotments to be made by the Director of Finance, State of Hawai i, pursuant to Chapter 37, Hawaii Revised Statutes, to pay the CONTRACTOR a total sum of money not to exceed SD{TY-TWO THOUSAND, AND NO/100 DOLLARS ($62,000.00), consisting of federal funds, which shall be paid in accbrdance,with and subjet;t to the follbwing: • ' 1. Payments shall be made upon the submission by the CONTRACTOR of invoices.in triplicate for the services to be provided in accordance with Attachment "1," "Scope of Services". The invoice for the pwchase of not less than seventeen Automated External Defibrillators shall include submission of a completed contract of sale or signed purchase order; and shall not exceed FORTY-SD{ THOUSAND AND NO/100 DOLLARS w _ (S46,Q0.00). 2. Expenditure reports shall be submitted to STATE certified by the CONTRACTOR to writain expenditures actually incurred for the services provided in the MOA. ' 3. The expenditure reports shall be reviewed by the STATE and shall be subject to the STATE's preliminary determination of appropriateness and allowability of the reported expenditure's. The STATE's preliminary. determination of appropriateness and allowability of the reported expenditures shall be subject to later verification and subsequent audit 4. If, after payment, investigation and examination reveal expenditures that are determined by the STATE to be inappropriate and unallowable, the STATE may require that an equivalent amount of monies be refunded by the CONTRACTOR, notwithstanding the STATE's preliminary determination of appropriateness and allowability. Final settlement of this MOA shall include submission and acceptance of all reports and other DOH REF. NO. No change, modification or amendment of this MOA shall be of any effect unless it is made in writing and signed by STATE and the CONTRACTOR Entire Agreement 'This MOA contains the entire agreement concerning the subject matter of this MOA. It snpercedes all negotiations, statements, promises, or understandings, if any, made prior to the execution of this MOA.
