SUBJECT: Resolution Authorizing the Mayor or his Duly Authorized
Representative to Negotiate and to Execute Necessary
Documents with WB KD Acquisitions, LLC, to Satisfy
Condition "T" of Ordinance No. 99-42.
The Office of Housing and Community Development (OHCD) submitted
a Resolution Authorizing the Mayor or his Duly Authorized
Representative to Negotiate and to Execute Necessary Documents
with WB KD Acquisitions, LLC, to Satisfy Condition "T" of
Ordinance No. 99-42.
The Hawaii County Housing Agency reviewed and approved the
resolution at its meeting on July 7, 2004, and voted as follows:
AYES: J. Arakaki, L. Elarionoff, F. Holschuh,
J. Reynolds, J. Tyler, G. Safarik - 6
NOES: B. Jacobson - 1
ABSENT AND EXCUSED: A. Chung, M. Tul.ang - 2
Accordingly, I am requesting that this resolution be included on
the Council agenda for action at its July 23, 20C4, meeting.

RESOLUTION APPROVING SATISFACTION OF CONDITION "T" OF ORDINANCE
NO. 99-42 BY WB KD ACQUISITIONS, LLC
WHEREAS, WB KD Acquisitions, LLC (WB KD) is the current
lessee of approximately 876.553 acres of land at Ka'upulehu,
North Kona, Hawaii, covered by tax map key 3/7-2-03:01,
Lot 4-A; and
WHEREAS, on April 10, 1999, Change of Zone Ordinance No.
99-42 became effective which rezoned the Property and adjacent
lands to Project District; and
WHEREAS, Condition "T" of Change of Zone Ordinance
No. 99-42 requires compliance with the requirements of
Chapter 11, Article 1, Hawaii County Code, relating to
Affordable Housing; and
WHEREAS, residents of West Hawaii cannot find affordable
housing units to purchase or to rent; and
WHEREAS, pursuant to Chapter 11, Section 11-4 (c) of the
Hawaii County Code, the Office of Housing and Community
Development is recommending that WB KD satisfy Condition "T" by
producing affordable housing.
NOW, THEREFORE, BE IT RESOLVED BY THE HAWAII COUNTY
HOUSING AGENCY that pursuant to Chapter 11 of the Hawaii County
Code, WB KD be required to develop eight (8) finished lots or
affordable units, either for rent or for sale, at prices that
meet the affordable housing guidelines, on site or within a
thirty (30) mile distance of the property.
BE IT FURTHER RESOLVED, that this resolution shall take
effect immediately.
