RESOLUTION NO. 2~°'
RESOLUTION AUTHORIZING THE MAYOR OR HIS DULY AUTHORIZED
REPRESENTATIVE TO NEGOTIATE AND TO EXECUTE NECESSARY DOCUMENTS
WITH RS10 KALAOA, LLC, TO SATISFY CONDITION "K" OF ORDINANCE N0.
97-56.
WHEREAS, RS10 Kalaoa, LLC, is the owner of approximately
10.28 acres of land at Kalaoa, North Kona, Hawaii, covered by
tax map key 3/7-3-10:37; and
WHEREAS, on April 7, 1997, Change of Zone Ordinance No.
97-56 became effective, which changed the district
classification from Agricultural (A-5a) to Single-Family
Residential (RS-10); and
WHEREAS, Condition "K" of Change of Zone Ordinance
No. 97-56 requires compliance with the requirements of
Chapter 11, Article 1, Hawaii County Code, relating to
Affordable Housing; and
WHEREAS, residents of West Hawaii cannot find affordable
housing units to purchase or to rent; and
WHEREAS, pursuant to Chapter 11, Section 11-4 (c) of the
Hawaii County Code, the Office of Housing and Community
Development is recommending that RS10 Kalaoa, LLC, satisfy
Condition "K" by producing affordable housing units.
NOW, THEREFORE, BE IT RESOLVED BY THE HAWAII COUNTY
COUNCIL that the Mayor or his duly authorized representative is
authorized to negotiate with RS10 Kalaoa, LLC, and to execute
necessary documents to satisfy Condition "K" of Ordinance No.
97-56 in accordance with Hawaii County Housing Agency
Resolution 139.
BE IT FURTHER RESOLVED, that this resolution shall take
effect immediately.
