Dear Hawaii County Council Chairman and Members,
On July 12, 2004 the Hawaii County Council proposed to pass Resolution No. 197-04,
Water Improvement District, Kona Coastview and Kona Wonderview Subdivisions, North
Kona, Hawaii to consist of the design, construction, acquisition and installation of a public
water system for the Improvement District consistent with applicable Dept. of Water
Supply standards and thereafter owned, operated, and maintained by the Dept. of Water
Supply. The majority of the 437 property owners within the Water Improvement District
are without Dept. of Water Supply, County of Hawaii water. Only a small number of
individuals (119), including myself, are currently on Dept. of Water Supply, County of
Hawaii water. Upon Resolution No.197-04 passing, I will be assessed a prorated fee of
$9,694.50 for this improvement which I believe unfair as I already have water from the
Dept. of Water Supply, County of Hawaii.
The 119 property owners on Dept. of Water Supply, County of Hawaii water represents
approximately 27% of the total 437 Water System Improvement District property owners.
437 minus 119 equals 318. The Net Project Cost of $4,236,495.00 divided by 318
equals $13,322.31. $13,322.31 is not much more than $9,694. 50. In all fairness, the
119 property owners on Dept. of Water Supply, County of Hawaii water should not have
to pay for something they already have. If you truly are planning to use this project as an
example for other communities, I assure you that you will have the same feeling of
resentment and unfairness with their existing property owners on Dept. of Water Supply,
County of Hawaii water. No one wants to pa for something they already have. The
property owners not currently on the Dept. of Water Supply ,County of Ha/w~aii water will

have a tremendous value for their money. The property owners, such as myself, who are
currently on Dept. of Water Supply, County of Hawaii water will have little improvement.
When I first puchased this property with existing Dept. of Water Supply, County of
Hawaii water I thought it was a good purchase. Now I feel that I am being penalized for
having a home with Dept. of Water Supply, County of Hawaii water. Your Water System
Improvement District protect is a good project. I want everyone to experience the same
level of service I have been experiencing over the past 13 years or so at this particular
property. The solution is to let the property owners currently without Dept. of Water
Supply, County of Hawaii water have their Water System Improvement District project
and let them pay for it completely on their own, excluding the 119 property owners that are
already on Dept. of Water Supply, County of Hawaii water. I should not have to feel that
now I need to sell my home because I am being treated unfairly.
I, John D. Dykes Jr., TMK (3)7-3-015-030-0000 do not want to be included within the
proposed Water Improvement District. I ask that the Hawaii County Council ammends the
upcoming Resolution of Determination to not include me within the proposed Kona
Coastview and Kona Wonderview Water Improvement District and to exempt and delete
prorated project assessment cost to me, John D. Dykes Jr., TMK (3)7-3-015-030-0000.
Monies I have paid for years for water usage to the Dept. of Water Supply, County of
Hawaii has supported the operation, improvement, and maintenance of the Dept. of Water
Supply, County of Hawaii Water System islandwide. Assessment of additional fees to
me, a metered property owner is unfair. It is my opinion that I, an owner of property within
Kona Coastview and Kona Wonderview subdivisions, North Kona, Hawaii currently on
Dept. of Water Supply, County of Hawaii water with a County meter be exempt from any
and all cost assessed to the proposed Water System Improvements pursuant to
Resolution No. 197-04 and not be included in the final project cost assessment.
Your ammendment of Resolution No. 197-04 exempting and deleting me, John D. Dykes
Jr., TMK (3)7-3-015-030-0000, a property owner on Dept. of Water Supply, County of
Hawaii water with a County meter from assessed project cost within the Kona Coastview
and Kona Wonderview Water System Improvement District is greatly appreciated.
According to your Project /Legislative Timetable, on July 23, 2004, there will be the
Council Resolution of Determination based on 7/12 public hearing. Please contact me in
regards to your desicion.
