RE: Resolution No. 203-04, Draft 2 - Pahoa Village Resource Park
Enclosed for your consideration is a proposed draft 2 which places a limit on land
acquisition costs in the third resolved clause. The changes between the original Resolution and
draft 2 are as follows:
BE IT FURTHER RESOLVED that in the process of said proceedings in eminent
domain, the Corporation Counsel be and is hereby authorized and empowered to negotiate terms
of settlement, not to exceed $500,000 for land acquisition, in accordance with section 2-10,
Hawaii County Code, and the approval of the court before which such proceedings are
prosecuted.
