Compliance of Condition G -Fair Share Contribution

We acknowledge receipt of your June 15, 2004 transmittal with submission of Check
No. 110 in the amount of $28,956.64 (4 lots @ $7,239.16) for payment towards the fair
share contributions as required by Condition G of the above-referenced ordinance. We
are also in receipt on July 12, 2004 of subsequent transmittal and Check No. 112 in the
amount of $27,931.32. Enclosed is your receipt. Said check is to replace Check No. 110,
as you have submitted documentation for credit ($1,700) towards the road and traffic
improvements fair share contribution. As agreed, Check No. 110 was returned hand
delivery to you on July 12, 2004.
Please be advised that Condition G further states, in part, the following:
"The fair share contributions described above shall be adjusted annually
beginning three years after the effective date of the change of zone, based on the
percentage change in the Honolulu Consumer Price Index (HCPI). In lieu of
paying the fair share contribution, the applicant inay construct and contribute
improvements/facilities related to parks and recreation, fire, police, solid waste
disposal facilities, and roads within the region impacted by the proposed
development, subject to the approval of the director.

The cost of providing and constructing the improvements required in Condition E shall
be credited against the sum specified in Condition G (5) for road and traffic
improvements."
The effective date of Ordinance No. 99 137 is December 10, 1999. Therefore, we are
applying the three years adjustment based on the adjustment change in the Honolulu
Consumer Price Index (HCPI). The first line of the fol]owing table shows the amount for
each fair share contribution per lot in accordance with said ordinance. The second line
shows the calculations of the first line dollar figwe multiplied by the HCPI adjustment of
1.0233 to get the adjusted dollar amount due per lot. (This is the ratio of the HCPI at the
end of 2003 to the HOPI at the end of 2002.)

Condition E of said ordinance states, "Install street lights, signs and markings meeting
with the approval of the Department of Public Works." Your receipt documentation
shows that the sum of $1,700 was paid directly to Department of Finance for installation
of a required street light. Based on this, the $1,700 will be credited against the fair share
contributions for road and traffic improvements.
Based on the above, the fair share contributions due for the proposed 4 lots, are as
follows:
Park 4 x $ 3,572.19 = $ 14,288.76
Police 4 x $ 172.32 = $ 689.28
Fire 4 x 340.36 = 1,361.44
Solid Waste 4 x 149.01 = 596.04
Road 4 x 3,173.95 = 12,695.80
TOTAL Fair Share Due $ 29,631.32
Less Credit for Street Light Expense 1,700.00
Remaining Fair Share due 27,931.32
Less Check No. 112 27,931.32

By receipt of the above credit and payment, the applicant has complied with Condition G
relating to fair share contribution for the proposed four (4) lots.
