Rezonin Ordinance No. 97-102. TMK 5-9-1: 8 The subject property was rezoned into the RS-15 district on July 14, 1997. Condition T of referenced ordinance required the submittal of an annual report. This report is thus being submitted in fulfillment of that condition. Subsequent to the effective date of the subject ordinance, the applicant has taken steps to develop the site in a timely fashion. The following were accomplished during this period: a. A SMA Use Permit (SMA 379) for the proposed developed was granted by the Planning Commission on August 8, 1997; b. Pursuant to Condition L relating to housing, an agreement was reached with the County Office of Housing and Cornmunity Development (OHCD). It is our understanding that OHCD informed your office of the applicant's fulfillment of this condition. Enclosed is a copy of my letter of March 2, 1998 to the OHCD with the executed agreement for your records; and c. The archaeological inventory survey was approved by the State DLNR-HPD on June 8, 1998. A copy is attached for your records. As you know, an approved report is needed before a Data Recovery Plan and Preservation Plan can be prepazed, as required by Condition M. We aze now in the process of soliciting proposals from vazious consulting archaeologists to implement this condition. It is anticipated that selection of a consultant and work on this component would begin later this year. " ~ 6~'~65 Ms. Vuginia Goldstein, Director July 9, 1998 Page 2 The applicant is awaze that there aze other conditions that are required to be implemented prior to receipt of final subdivision approval. These include the conditions relating to coastal access, impact fees, "no-ohana" restrictive covenants, solid waste management plan, and the like. Proposals for the master plan and first phase engineering have been solicited, and this work should commence very soon. The applicant is fully awaze that final subdivision approval must be secured before July 2002. The applicant is working towazds approval of the first phase, hopefully within the next year..
