HomeMy WebLinkAboutRES 217 Draft 01 2002-2004 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 217 ®4 RESOLUTION AUTHORIZING THE EXCHANGE, IN FEE SIMPLE, OF TAX MAP KEY (3) 7-5-04:63 FOR TAX MAP KEY (3) 8-2-03:5 AND THE REPEAL OF RESOLUTION NO. 241-00. WHEREAS, the County of Hawaii is the owner of that certain parcel of land, being Lot 6 of "Crossroads," situated at Lanihau 1 s`, North Kona, Hawaii, further identified as TMK: (3) 7-5-04:63; and WHEREAS, Lot 6 is roughly triangular in shape and contains an area of 43,562 square feet, more or less (Exhibit "A"); and WHEREAS, the County of Hawaii does not have plans to utilize Lot 6 for any of its programs; and WHEREAS, Pineta Company, Inc. is the owner of that certain parcel of land situated at Kealakekua, South Kona, Hawaii, further identified as TMK: (3) 8-2-03:5; and WHEREAS, this parcel of land is roughly rectangular in shape and contains an area of 7.098 acres, more or less (Exhibit "B"); and WHEREAS, the County is desirous of constructing a new police station for the South Kona area and finds the subject property to be an appropriate central location for siting this new facility; and WHEREAS, Pineta Company, Inc. has proposed an exchange of their Kealakekua property (TMK: (3) 8-2-03:5) for the real property situated at Lanihau (TMK: (3) 7-5-04:63); and WHEREAS, according to Section 21-115(c), Hawaii County Code, the fair market value of the private land and the County-owned land shall be separately determined by a disinterested qualified appraiser and the cost thereof shall be borne equally by Pineta Company, Inc. and the County; and WHEREAS, if the real property and the private property proposed to be exchanged are not of substantially equal value as determined by the appraisal, a settlement may be negotiated by the parties by adding cash or other real property to make the properties substantially equal in value. WHEREAS, Section 2-111(a)(3), Powers of Council, Hawaii County Code, provides that the Council may, by resolution approved by a majority of its members, direct the Finance Director to exchange real property for private property. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, through its authority under Section 2-111(3), Hawaii County Code, that the Finance Director is authorized to exchange Lot 6 of the "Crossroads," (TMK (3) 7-5-04:63) for TMK: (3) 8-2-03:5 in a manner consistent with the applicable sections of Chapter 2, Article 19, Real Property Disposition, Hawaii County Code. BE IT FURTHER RESOLVED that the exchanged subject property (TMK: 3- 8-2-03:5) shall only be used for a public purpose, to site a new police facility, pursuant to Section 2-115(a), Hawaii County Code. BE IT FURTHER RESOLVED, that Resolution 241-00, which originally authorized the proceeds from the sale of the subject property to be used for projects in the North Kona district, is hereby rescinded. BE IT FURTHER RESOLVED that the County Clerk shall transmit a copy of this resolution to the Honorable Harry Kim, Mayor of the County of Hawaii, William Takaba, Director of Finance, Police Chief Lawrence Mahuna, and Pineta Company, Inc.
