Subject: Resolution No. 218-04, Draft 2
Attached for consideration is Resolution No. 218-04, Draft 2. Throughout the resolution we made changes
in formatting and punctuation with the intent to make the reading easier or clearer. For example, in the Th
whereas clause, most of the bullet listings were change by deleting commas and replacing them with periods.
The following is a listing of more important changes we are recommending.
1. Title: The title been amended by adding the acronym WRT which will appear in different sections of
the resolution. Also a period has been added to the end of the title.
2. 15~ and 2nd whereas clauses: Upper case letter have been changed to lower case and the
sequence of some words were changed.
3. 3rd whereas clause: The following was added to reference the resolution that calls for expediting
the RFP process.
WHEREAS on May 5 2004 the Hawaii County Council adopted Resolution No.180-04, which
supports expediting the process to bring online a WRT• and
4. 4`h whereas clause:
? Deleted the word [ems] and replaced it with the County's
? Deleted [tlie) and added its two; this clazifies that we are talking about two landfills: Hilo and
Puuanahulu.
? The period was deleted and (WRT); and was added. This indicates that another whereas
clause is coming.
5. 5`h whereas Clause: This clause was added to point out that the first step for the RFP was the
establishment of procurement criteria. 1

WHEREAS the Council recoenizes that in order to expedite the Reuuest For Proposal (RFPI for a
WRT, procurement criteria that consistently matches County policies needs and waste stream must be
established first; and
6. 6"' whereas Clause: This clause was added to reference the Communication (684.1) and the
meeting and the ensuing discussion that was the basis for the procurement criteria used in this
resolution.
WHEREAS, during the Parks and Environmental Committee meetine on July 22 2004 Comm 684 1
which outlined the initial assessment of findings gathered from the Request For Information (RFI)
process, was discussed at len tg h; and
7. Given the amendments in this draft, the following is no longer needed and is deleted:

8 7rn whereas Clause: This clause was added to list the findings and indicate the need to incorporate
these findings in the RFP.
WHEREAS, in light of the information eathered at the Parks and Environmental Management
Committee meeting, including the analysis and input voluntazilyprovided by consultant Ted Vorfeld,
President of Hualalai En ineerin the followin rocurement criteria are deemed essential and need
to be incorporated into the RFP:
Please note the following changes in the bullets that follow this 7`" whereas clause:
? Bullet #10 was deleted and then partially combined with bullet #16, since they were similar in intent.
These amendments aze shown below.
Vendor needs to demonstrate end markets and a firm price commitment (in the form of a letter of
commitment) by a purchaser for their facility's primary product, where those revenues exceed 20% of
the projected product revenue[,],
? Bullet #17 was amended by adding specific language to cover identified damages to the County due
to vendor defaults.
A performance bond with a minimum of $5 [A4iMien,] million to cover County identified damages
due to vendor defaults.
? Bullet #19 was added to specify a minimum diversion rate of 75% from the landfills (excluding the
County recycling programs).
Diversion from landfills, exclusive of County recvcling~rograms, shall be at a minimum rate of
75%: and
9. 8m whereas Clause: This clause was established to setup a timeline for the RFP process:
WHEREAS the timeline for implementing and processing the RFP will be as follows:
• The RFP will be completed and published island-wide statewide and posted on appropriate
industry related websites by October 31, 2004.
• Vendors will have three (31 months to prepaze proposals and no proposals will be accepted
after Januazv 31, 2005.
• The RFP evaluation committee, which shall be composed pursuant to Resolution No 238-02
will recommend at least one but no more than two vendors to the County Council by April 30
2005.
• The RFP evaluation committee's recommendation(s) shall be discussed in Executive Session
by the County Council and a contract with the selected WRT vendor will be neeotiated and
the contract execution date shall be no later than Julv 31 2005 • and
10. 9`h whereas Clause: We changed the formatting under the second bullet by aligning the numbers
the numbers to the left. Further the third bullet was change to number seven and the language was
amended to specify that the intent was to inform and educate the community regarding WRTs.

11. Now, therefore, be it resolved clause: This clause is added to state the resolve that the RFP
process will be guided by the criteria set forth in this resolution; it also sets a timeline for the process.
NOW, THEREFORE, BE IT RESOLVED by the Council of the County of Hawaii that the RFP
process for a WRT will be based on and uig ded by the procurement criteria and timeline enumerated
in this resolution.
12. 15~ Be it father resolved: This clause states the additional resolve to work on the delineated
actions at the same time as the RFP.
BE IT FURTHER RESOLVED that the County, in tandem with the WRT process, will proceed with
the delineated actions cited above.
13. 2°d BE it further resolved: This final clause was amended by prefacing the Mayor with the
appropriate honorific; also the spelling of Hawaii was corrected.
BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the Honorable Harry
Kim, Mayor, County of [~Iawar-I] Hawaii; Barbara Bell, Director, Department of Environmental
Management, County of Hawaii; and the Hawaii County Environmental Management Commission.
