RE: Resolution No. 203-04, Draft 3
For your consideration, this is to transmit the following proposed amendment to Resolution No.
203-04, Draft 3:
BE IT FURTHER RESOLVED that the authorization contained herein shall be
conditioned upon the Corooration Counsel first determining that the total value of the
properties sought to be obtained does not exceed $500 000. Upon such determination
that said value does not exceed $500,000, and in addition to its authorization to proceed
in eminent domain, [in the process of said proceedings in eminent domain,] the
Corporation Counsel shall be [and is hereby] authorized and empowered to negotiate
terms of settlement, not to exceed $500,000 for land acquisition, in accordance with
section 2-10, Hawaii County Code, and the approval of the court before which such
proceedings are prosecuted.
