RESOLUTION REQUESTING THE GOVERNOR AND THE LEGISLATURE
TO CONVENE A SPECIAL SESSION TO RESOLVE THE PRIVATIZATION ISSUE
Whereas, for many years, the Cuunty of Kauai and numerous other governmental
agencies in the State have had contracts with private parties to provide services to the public;
and
Whereas, this system for providing services [o the public has been put in turmoil because
of the recent decision in Konno, which ruled that government cannot privatize services without
the express consent of the Legislature; and
Whereas, the Konno decision has spawned different interpretations among the various
governmental agencies, has created confusion for private service providers, and has resulted in
extensive litigation in the various Courts; now therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUAI, STATE OF
HAWAII, that it requests the Governor and the Legislature to immediately convene a special
session of the Legislature to resolve the privatization issue.
BE IT FURTHER RESOLVED, that copies of this Resolution be transmitted to Governor
Cayetano, Senate President Mizuguchi, House Speaker Souki, all Legislators, Mayor Kusaka,
and the Mayors and Council Chairpersons of the other counties.
