CALL TO ORDER STATEMENTS FROM THE PUBLIC ON ITEM ON THE AGENDA REFERRAL Comm. 722: AN ORDINANCE AMENDING SECTION 25-8-3 (NORTH KONA ZONE MAP), (Bill 309) ARTICLE 8, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE, BY CHANGING THE DISTRICT CLASSIFICATION FROM OPEN (O) TO INDUSTRIAL-COMMERCIAL MIXED (MCX-20) AND GENERAL INDUSTRIAL (MG-]a) AT HONOKOHAU 1st AND 2nd, NORTH KONA, HAWAII, COVERED BY "PAX MAP KEY 7-4-8:PORTION 13 & 30. (Applicant: West Hawaii Business Park, LLC.)(Area: Parcel 1 Approximately 186.733 acres and Parcel 3 Approximately 9.901 acres to MCX-20; Parcel 2 Approximately 85.733 acres to MG-1 a) From Mayor Harry Kim, dated July 29, 2004, transmitting a letter and the above bill from Planning Commission Chair Fred Galdones. At its meeting of July 16, 2004, the Planning Commission considered a motion to send a favorable recommendation, as recommended by the Planning Director, to the Council. The vote on the motion was four "ayes" and three "noes," which constitutes a "no action" by the Planning Commission, because of the lack of the five affirmative votes required by the Hawaii County Charter, Section 13-4(I). Under Section 25-2-42(d)(3) and Planning Commission Rules 11-3(b)(2), the Commission's non-action constitutes an unfavorable recommendation. Therefore, the application is being forwarded to the Council with an unfavorable recommendation.
