From Mayor Harry Kim, dated July 29, 2004, transmitting a letter and the above bill from
Planning Commission Chair Fred Galdones.
At its meeting of July 16, 2004, the Planning Commission considered a motion to send a
favorable recommendation, as recommended by the Planning Director, to the Council.
The vote on the motion was four "ayes" and three "noes," which constitutes a "no action"
by the Planning Commission, because of the lack of the five affirmative votes required by
the Hawaii County Charter, Section 13-4(I). Under Section 25-2-42(d)(3) and Planning
Commission Rules 11-3(b)(2), the Commission's non-action constitutes an unfavorable
recommendation. Therefore, the application is being forwarded to the Council with an
unfavorable recommendation.
