HomeMy WebLinkAboutCOM 0685.001 2002-2004 Agreement No. 68300040001 Agreement Between DRAFT the United States Department of the Interior J National Park Service ~ ~ ~ ~ ~ ~ and the Hawaii County Fire Department This Agreement is entered into by and between the National Park Service (hereinafter "NPS"), United States Department of the Interior, and the Hawaii County Fire Department (hereinafter "Department"), a government entity of the County of Hawaii located in Hilo, Hawaii. ARTICLE I -BACKGROUND AND OBJECTIVES As of December 31, 2004 the military is withdrawing their 24-hour fire truck and personnel at the Kilauea Military Camp ("KMC") within the boundaries of Hawaii Volcanoes National Pazk ("HAVO") after 50 plus years of providing that service. The Department is scheduled to bring in their structural fire personnel on January 1, 2005 to staff a new County Fire Station that eventually will be built just outside HAVO. The nearest 24-hour fire station is over 25 minutes away. The Congress had directed the NPS to provide funding in the amount of $250,000 to the Department for the procurement of a structural fire engine that will be located and operated at Station 19 cun•ently located at KMC. The Department has agreed to staff and operate Stationl9 on a 24-hour basis starting on January 1, 2005. Station 19 will include one Fire Engine Company and one ambulance. The objective of this Agreement is to establish the instrument under which the NPS will transfer the funding to the Department for the procurement of the fire engine. The Department has a standing Memorandum of Understanding (MOU) with the NPS which includes HAVO and three other National Park azeas on the Island of Hawaii. This Agreement supports the existing MOU between the NPS and Department providing for emergency response to fire, medical, and search and rescue incidents within HAVO. ARTICLE II -AUTHORITY This Agreement is entered into pursuant to House Report 108-330, "Making Appropriations for the Department of the Interior and Related Agencies for the Fiscal Year Ending September 30, 2004, and for other Purposes", wherein it states: uEC.EivN~ ' By County Cov~x)t (From Connie i:iriu) Comm. Uare JUL ~ J l.UU4 Agreement No. 68300040001 "The managers are aware that the U.S. Army will be relocating some of its fire and emergency services personnel currently located in Hawaii. This relocation will severely undercut the availability of vital services at Hawaii Volcanoes National Park. The managers understand, and greatly appreciate, that the County of Hawaii is willing to provide these services and direct the [National Park] Service to provide the county with $250,000 in transition funding." ARTICLE III -STATEMENT OF WORK A. The Department will: 1. Initiate billing procedures on or after July 1, 2004 for the agreed amount funds of $250,000 and submit a bill to the NPS for such amount by August 1, 2004. 2. Promptly upon receipt of the agreed funds apply those funds towards the purchase of a structural fire engine during the Hawaii County 2005 fiscal yeaz. 3. Not sell, transfer, assign, pledge, encumber, surplus, discard, or otherwise dispose of the Fire Engine purchased for Station 19 without consultation with the NPS. B. The NPS will: In consultation with the Depaztment, within 60 days of receiving a bill for the agreed amount of funds, deposit those funds to the County of Hawaii. ARTICLE IV -TERM OF AGREEMENT This Agreement will be effective for a period of 120 days starting from July 1, 2004 or the date of final signature after July 1, 2004, unless it is terminated by one of the parties pursuant to Article VII that follows. Mayor Hawaii County 25 Aupuni Street, Room 215 Hilo, HI 96720 Email: cohsecy@interpac.net Telephone: (808) 961-8211 Facsimile: (808) 961-6553 ARTICLE VI -AWARD AND PAYMENT The NPS will provide funding in the amount of $250,000 to the Department to be used for the purchase of a fire engine. The chazgeable appropriation for this Agreement is 8303-RA01-454. ARTICLE VII -MODIFICATION AND TERMINATION A. This Agreement maybe modified only by a written instrument executed by the parties. B. Either pazty may terminate this Agreement by providing the other party with thirty (30) days advance written notice. In the event that one party provides the other pazty with notice of its intention to terminate, the parties will meet promptly to discuss the reasons for the notice and to try to resolve their differences.
