Curtis Tyler, II ~u~~6 <br /> Vice Chair ~ ' <br /> RE: Bill No. 178, Draft 4 <br /> Clifto's <br /> <br /> This is to transmit the following proposed amendments to Bill No. 178, Draft 4: <br /> J. To avoid creating a scattered, strip development pattern along the Queen Kaahumanu Highway, <br /> development shall proceed incrementally, and the initial development increment shall consist of <br /> a minimum of 30,000 square feet of gross floor space in commercial and/or office use, or not <br /> less than 60 residential units, or not less than 60 hotel units. Actual construction under a bona <br /> fide construction contract of the initial development increment shall begin not more- than four <br /> years of the approval of an SMA permit allowing the project, or not more than five years from <br /> the approval of this ordinance, whichever comes first, and shall be completed within two years <br /> of commencement. However, a Certificate of Occupancy for anv ortion of the develonnment <br /> other than the residential.[ ],component shall not be <br /> issued until-Queen Kaahumanu Highway, Phase II, from Keaiakehe to the Airport, has been <br /> widened to a minimum of four traffic lanes end o en to the a~ixhlic or within [~e]years from <br /> the effective date of this ordinance, whichever occurs first. <br /> X. The applicant shall [ ]prepare or cause the preparation of <br /> construction plans, under the supervision of and meeting with the approval and requirements of <br /> the State Department of Transportation (DOT), for the widening of the Queen Ka' ahumanu <br /> Highway between the end of Phase I in the vicinity of the Honokohau Boat Harbor to the Kona <br /> Airport. A scope of work for the construction plans shall be submitted to the State DOT within <br /> 90 days of the effective date of this ordinance. The applicant shall make its-best effort to have <br /> the construction plans submitted to -the -State DOT for review and approval within a year of the <br /> approval of the scope of work. The cost to prepare this plan shall be credited against <br /> Conditions AA and NN relating to regional roadway improvements.
