SUBJECT: Bi1128Q Draft 5 through 6, Ordinance amending Chapter 3 of the Hawaii County
Code amending Article 2 -Relating to Kailua Village Signs
The Kailua Village Design Commission, at its meeting of August 17, 2004, after hearing public
testimony at a previous meeting, and after concluding a review of the proposed changes to the
Sign Code as it affects the Kailua Village Special Design District, passed the following motion.
"The Kailua Village Design Commission strongly recommends that changes be made to the Sign
Code, and is recommending approval of the proposed Sign Code, in accordance with the
following nine recommendations.
1. Marquee Signs, as proposed, should be included in the Sign Code.
2. The proposed section limiting Wall Sign height to the lesser of 14 feet or one-half the height
of the building should be deleted. This section should be replaced with a new section
applicable to all areas of the Kailua Village Special Design District except for the Industrial
zoned azeas, limiting Wall Sign height to 9-1/2 feet above the finish floor elevation of each
floor of a building.
3. The Kailua Industrial Subdivision, as proposed, including the special provisions for the larger
wall sign areas and the lazger symbol and lettering sizes, should be included in the Sign
Code.
4. The proposed section giving authority to grant a sign variance to the Hawaii County Council
should be deleted. This section should be replaced with a new section, giving authority to
grant a sign variance to the Kailua Village Design Commission for those sign variances

occurring within the Kailua Village Special Design District, and to Planning Commission for
those areas outside of the Kailua Village Special Design District.
5. The proposed sections on enforcement authority that gives exclusive enforcement authority
to the Director of Public Works should be revised. The Kailua Village Design Commission
strongly recommends that the Director of Planning be given enforcement authority for sign
violations occurring within the Kailua Village Special Design District, and that the Director
of Public Works be given enforcement authority for those areas outside of the Kailua Village
Special Design District.
6. The section promoting the preparation of educational material describing the provisions of
the Sign Code ordinance, with drawings and photographs, should be included in the Sign
Code.
7. The proposed section on Administrative Enforcement of the Sign Code should be included in
the Sign Code.
8. Anew section should be added to the Sign Code that directs the County agencies responsible
for Sign Code enforcement, together with the Department of Corporation Council, to review
the procedures used for Sign Code enforcement, and to develop more streamlined and
efficient violation citation and enforcement procedures.
9. The proposed section allowing single temporary unlighted signs for a period not to exceed
six months should be deleted. This section should be replaced with a new section allowing
single temporary unlighted signs for a period not to exceed 30 days."

before the September 1, 2004, Council meeting. Thank you for your assistance in this important
