RESOLUTION NO. 232 04
RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN
AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF HEALTH,
PURSUANT TO HRS 46-7, FOR THE BEVERAGE CONTAINER DEPOSIT
PROGRAM GRANT
WHEREAS, the State of Hawaii Department of Health (DOH), by law, must implement the
Beverage Container Deposit Program by January 1, 2005; and
WHEREAS, under the Beverage Container Deposit Program, a redeemable deposit fee is
collected on all eligible beverage containers in a effort to encourage recycling and reduce land
disposal and illegal dumping of affected containers; and
WHEREAS, a separate container fee is also collected by the State's DOH from the beverage
industry for each eligible container and a portion of those container fees are then being distributed to
the counties to assist in developing and monitoring public redemption centers; and
WHEREAS, the State DOH, recognizing that it would be better to have each county be
responsible for the development and monitoring of their own program, has authorized funding to the
County of Hawaii for its Beverage Container Deposit Program; and
WHEREAS, the County's Department of Environmental Management's Recycling Section has
been requested to assume responsibility for implementing and monitoring the Beverage Container
Deposit Program; and
WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain
the consent of the council to enter into agreements with the federal or state governments respecting
action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any
funds or other assistance in connection with projects being or to be undertaken pursuant to those
powers.
NO1101, THEREIFORE, BE IT RESOLVE® BY THE COUNCIL OF THE COUNTY OP HAWA?1`I,
in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the County of Hawaii is
authorized to execute, on behalf of the County, an agreement and related documents, to enable the
County to develop, implement, and monitor its Beverage Container Deposit Program as described in
its scope of services to the Department of Health, attached hereto and incorporated herein by
reference as Exhibit "A".
~E IT FURTHER RESOLVED that the County Clerk of the County of Hawaii shall transmit
copies of this resolution to the Office of the Mayor, the Departments of Environmental Management
and Finance.

SCOPE OF SERVICES
DEPOSIT BEVERAGE CONTAINER PROGRAM
1. The CONTRACTOR shall provide monitoring support including, but not limited to,
the following:
a. Monitor certified redemption centers to make sure the centers are following
certification requirements;
b. Monitor the handling and processing of materials by certified redemption
centers to ascertain if they are in compliance with law;
c. Asses site establishment of certified redemption centers for service to public;
d. Identify communities where opportunities for redemption of deposit beverage
containers are nonexistent or not practical;
e. Determine need for State or County to assist in establishing redemption
centers in a gap or rural area;
f. Assist in securing sites and establishing redemption centers in areas of need;
and
g. Provide other monitoring support as needed.
2 . The CONTRACTOR shall provide technical assistance including, but not limited to,
the following:
a. Manage contracts between the County and certified redemption center
operators;
b. Provide technical assistance and support to private sector businesses actively
developing or participating in the program;
c. Assist in researching funding opportunities for recycled product research and
market development; and
d. Provide other technical support as required.

3. The CONTRACTOR shall provide education outreach including, but not limited to,
the following:
a. Provide educational and outreach support to promote and increase
participation in recycling of deposit beverage containers;
b. Assist in implementing and monitoring demonstration projects; and
c. Provide other education outreach support as needed.
4. The CONTRACTOR shall obtain staff to conduct monitoring support, technical
assistance, and education outreach activities including, but not limited to, activities
stated in this Scope of Services.
5. The CONTRACTOR shall prepare quarterly summary reports to include, but not
limited to, the following:
a. Update of monitoring support, technical assistance, and education outreach
activities;
b. Evaluation of program success; and
c. Recommendations for improvement.
