Pursuant to Section 92-5(a)(4), Hawaii Revised Statutes, as amended, we request
an attorney-client confidential discussion in executive session to consult with the County
Council on the above-entitled case. We ask that this case be placed on the County
Council's agenda for September 15, 2004, in Kona, due to the fact that a decision must be
made in this matter by September 17, 2004 to protect the County's right to appeal.
