STATE OF HAWAI`I 237 04 RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAI`I DEPARTMENT OF HEALTH, PURSUANT TO HRS 46-7, FOR THE BIG ISLAND JUVENILE INTAKE AND ASSESSMENT CENTER PROJECT GRANT WHEREAS, the State of Hawai`i Department of Health Child and Adolescent Mental Health Division has awarded a project grant to the Office of the Prosecuting Attorney for the establishment of the Big Island Juvenile Intake and Assessment Center (BIJIAC); and WHEREAS, the BIJIAC is a multi-agency effort that seeks to provide a single point of entry for intake, assessment and case management of delinquent and at-risk youth; and WHEREAS, this would also include the co-location of relevant agencies such as law enforcement, probation, health and other social service providers; and WHEREAS, the grant funds will be passed on to a qualifying agency to hire the project coordinator and assume management responsibilities of the project; and WHEREAS, Hawai'i Revised Statutes, Section 46-7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I, in accordance with section 46-7, Hawai'i Revised Statutes, that the Mayor of the County of Hawai`i is authorized to execute, on behalf of the County, the memorandum of agreement, attached hereto and incorporated herein by reference as Exhibit "A", for the establishment of the Big Island Juvenile Intake and Assessment Center. ~~ I1° FURTF~ER RESOLVED that 4he County Clerk of the County of Hawai'i shall transmit copies of this resolution to the OfFice of the Mayor, the Office of the I'rosecuting Atforney and the Departrnent of Finance. MEMORANDUM OF AGREEMENT BETWEEN THE DEPARTMENT OF HEALTH CHILD and ADOLESCENT MENTAL HEALTH DIVISION AND THE COUNTY OF HAWAII OFFICE OF THE PROSECUTING ATTORNEY This Agreement is made on the 27~h day of August 2004, by and between the Department of Health, State of Hawaii, Child and Adolescent Mental Health Division herein after referred to as the "DIVISION," and the County of Hawaii Office of the Prosecuting Attomey, hereinafter referred to as the "PROSECUTOR'S OFFICE," for the purpose of creating a Juvenile Intake and Assessment Center on the Island of Hawaii (JIAC). The DIVISION and the PROSECUTOR'S OFFICE mutually agree to perform their respective responsibilities and duties in accordance with the provisions of this Agreement. Period of AEreement: This Agreement shall be effective from September 1, 2004 through July 31, 2005. The DIVISION and the PROSECUTOR'S OFFICE may extend this Agreement for additional periods. Modification of AQreement: Any modification, alteration, or change to this Agreement shall be made only by written supplemental agreements executed by the parCies. 4. Termination of AQreement: The Division Chief or designee may, when the interest of the DIVISION so require, terminate this Ag~eement in whole or in part, for the convenience of the DIVISION. The DIVISION shall give thirty (30) days written notice of termination to the PROSECUTOR'S OFFICE specifying when termination becomes effective. The PROSECUTOR'S OFFICE may terminate this Agreement upon thirty (30) days written notice to the DIVISION. 5. DIVISION Responsibilities: The DIVISION will provide consultation, direction, and will coordinate with the PROSECUTOR'S OFFICE regarding mental health services as they apply to the creation of the JIAC. 6. COMPENSATION: The DNISION agrees, subject to the receipt of Federal funds under the Federal Grant and subject to allotments to be made by the Director of Finance, State of Hawaii, pursuant to Chapter 37, Hawaii Revised CAMHD Lo~ No. OS-009 I Page 1 of 3 EXHIBIT "A" Statutes, to pay the PROSECUTOR'S OFFICE a tota] sum of money not to exceed ONE HiJNDRED FORTY THOUSAND AND NO/100 ($140,000.00) from its Community Mental Health Services Block Grant funds for the Agreement period. a. Payments shall be made in two installments upon the submission by the PROSECUTOR'S OFFICE of invoices in triplicate for services provided. b. The first installment shall be an advance installment of approximately one-half (1/2) of the total compensation. a The second installment of approximately one-half (1/2) of the total compensation will be paid in Mazch 2005. PROSECUTOR'S OFFICE Resoonsibilities: a. The PROSECUTOR'S OFFICE shall procure the services of a Project Coordinator, who will assume the role of managing the creation of the JIAC. b. The PROSECUTOR'S OFFICE will submit quarterly progress reports by the 15~h day of the month following the end of a quarter. These reports shall include a reporting of expenditures, as well as the deliverables generated by the Project Coordinator to date. c. The PROSECUTOR'S OFFICE will submit a cumulative report at the end of the contract period. 8. Collaboration: Both the DIVISION and the PROSECUTOR'S OFFICE will collaborate on monitoring the performance of the Project Coordinator relative to agreed-upon deliverables. The PROSECUTOR'S OFFICE agrees to provide the DIVISION with access to records as needed. 9. Federal Citation. Pursuant to Subparts I and III of Part B of Title XIX of the Public Health Service Act, as amended, and Federal Regulations 45 C.F.R. Part 96, the Substance Abuse and Mental Health Services Administration of the Public Health Service of the United State Department of Health and Human Services has granted federal funds to the STATE under Block Grants for Community Mental Health Services, by Grant No. 03 B1 H1 CMHS-02, subject to the availability of funds, for the block grant award period from October 1, 2002 through September 30, 2004, Catalog of Federal Domestic Assistance No. 93.958, which notice of award, grant application, and other applicable documents and conditions are hereinafter collectively referred to as the "Federal Grant." 10. Audit Requirements. a. Nonprofit organization that expend $500,000.00 or more in a year of federal funds from any source shall have a single audit CAMHD Lo~ No. OS-009 ~ Page 2 of 3 conducted for that yeaz in accordance with the Single Audit Act Amendments of 1996, Public Law 104-156. b. lf the preceding condition applies, the PROVIDER shall conduct a financial and compliance audit in accordance with the guidelines identified in Exhibit "F," attached hereto and made a part hereof. Failure to comply may result in the withholding of payments to the PROVIDER. c. Nonprofit organizations that expend less than $500,000 a year in federal funds are exempt from federal audit requirements For that year, however, records shall be available for review or audit by appropriate officials of the federal awazding agency, the STATE, or General Accounting Office. d. If the PROVIDER is exempt from federal audit requirements in accordance with subparagraph c., above, the cost of any audit conducted on behalf of the PROVIDER shall not be charged to the federal portion of this AGREEMENT. If the PROSECUTOR'S OFFICE is exempt from federal audit requirements in accordance with subparagraph c, above, the cost of any audit conducted on behalf of the PROSECUTOR'S OFFICE shall not be charged to the federal portion of this Agreement.
