You gave us thirty (30) days to get back to the Council. Council member Tyler was not in favor of selling the remnant parcel at said meeting. I met with Curtis in Kona on August 25, 2004 pursuant to your request. Curtis still favors keeping the remnant parcel, but understands Mr. Benech's predicament. Curtis proposed instead to grant my Client Edmond Benech who is presently "land locked irrevocable easements over and across Lot R-2 (revised) for his existing driveway, for his existing water line to the meter on Alii Drive, for his existing sewer connection to Alii Drive and for his existing overhead utilities from Alii Drive to his home. Lot R-2 (revised) is a portion of an abandoned roadway deeded by the State to the County that lies between Alii Drive and Mr. Benech's mauka boundary. It contains a land area of 909 square feet and is trapezoidal in shape being 1.96 feet wide at its north end and approximately 5.0 feet wide at its South end, and is 150 long. Enclosed herewith is a map of said lot prepared by Chrystal Yamasaki, dated June 16, 2004. I communicated this easement approach to Mr. Stanley Iwamoto at Finance. It appeared to be more a liability than an asset because of its unusual shape and narrow width. The locations of the required easements across Lot R-2 occur at four separate points and will then divide Lot R-2 into five (5) lots. Each easement will be a separate lot unto itself then creating nine (9) lots on Lot R-2. At that point Lot R-2 will be useless to anyone. The County would stilt own Lot R-2 after granting the easements and would be saddled with its ongoing maintenance and liability. Both DPW and Finance urge the Council to sell the lot as set forth in Communication 727, Resolution 227-04. The sales price at $30.00 per square foot is more than fair considering the County got the remnant free from the State two years ago. Mr. Benech has agreed to pay the appraised price. I enclose a copy of my August 26, 2004 letter to Council Member Tyler that questions the practical aspects of the easement idea. It will create the "Nightmare on Elm Street Lot" for Stanley, Galen, the Council and the County. Based on the urgings of both DPW and Finance, and negative aspects of granting easements Communication 727, Resolution 227-04 is supported before the Public Works Committee by DPW, Finance, and Mr. Benech. It is opposed by Council Member Tyler. It appears to be a win-win situation. Mr. Benech would maintain the property and be responsible for any liability, he will no longer be "land locked" and all his utility connections would be legal. All the required information, descriptions, appraisals and documentation are part of the package before the Council.
