Yuen Planning Director County Of Hawaii, Planning Department RE: Change of Zoning Ordinance No. 98-36 TKM: 5-4-006:021 & 036 Annual Report Dear Mr. Yuen, Please accept this as the annual progress report for Ordinance No. 98 36. (A separate annual report for PUD No. 58 was submitted on 8/4/04.) Tinguely Development, Inc. has recently completed the purchase of the property referenced above. Tinguely Development, Inc. is proceeding with the subdivision as originally designed and is addressing the existing conditions as follows: Condition A. Tinguely Development is currently in the process of complying with all conditions. Condition B. The initial Water Commitment has been paid. Condition C. An extension has been granted for Final Subdivision Approval and such approval must be secured from the Planning Director by April 23, 2008. However, Tinguely Development, Inc. will submit new plans to the Planning Director by the end of this year. Condition D. The original Construction Drawings were approved by the Highway Division of the Dept. of Transportation on May 16, 2000. New construction plans are being developed for submittal. Access to the subject property from Akoni Pule Highway shall meet with the requirements of the Department of Transportation. The entrance roadway sight distance shall meet the requirements of the Statewide Design Manual. All lots will be accessed from one common access road. All roadways will be constructed in a manner meeting with the approval of the Department of Public Works (as modified by PUD #58). Condition F. Drainage improvements, if required, shall be constructed in a manner meeting with the approval of the Department of Public Works and/or State Department of Health. Condition G. A solid waste management plan will be created and submitted to the Department of Public Works. Condition H. The wastewater treatment and disposal system shall be designed in accordance with the requirements of the Department of Health. Condition I. Tinguely Development, Inc. will comply with the requirements of Chapter 11, Article 1, Hawaii County Code, relating to Affordable Housing. Condition K. DLNR-HPD will be notified immediately if any archeological remains are encountered. Condition L. Tinguely Development, Inc. will make its fair share contribution. Condition M. Tinguely Development, Inc. recognizes that the Ordinance conditions will be credited towards the requirements of any Unified Impact Fees Ordinance. Condition N. Tinguely Development, Inc. will comply with all applicable laws, rules, regulations and requirements of affected agencies for approval of the proposed development within the subject property. Condition O. Tinguely Development, Inc. recognizes the conditions on which an extension of time may be granted. Condition P. Tinguely Development, Inc. recognizes that failure to meet the above conditions may result in the rezoning of the subject property.
