reminder, the effective date of Change of Zone Ordinance No. 02-26 is March 19, 2002.

Changing the district classification
from Agricultural (A-5a) to Neighborhood Commercial (CN-10)

Dear Mr. Yuen:
in compliance with Condition S of our Change of Zone Approval, dated May 23, 2002, we are
required to submit to you an annual progress report addressing the status of the
development and the compliance with the conditions of approval. This letter is intended to
serve that purpose.
First, in general, the area is being redesigned to subdivide into two parcels: one for the
County Fire Station with a satellite police office, and a second lot that was planned last year
for three CPR commercial uses. However, in this last year we have discovered that there is
a much stronger need for affordable housing in our community and we are now considering
moving the fire station site plan to a front quadrant of this property and develop the balance,
approximately 100,000 square feet, into an affordable apartment complex. This would be
down zoning use. We have communicated with Daryn Arai about this.
As to the fire station, Oda/McCarty in Hilo has finished the design pending the final location
and accompanying civil engineering. A satellite police office was added which was not in the
original CIP approved for the fire station and our attorney, Steven S. Lim of Carlsmith Ball,
LLP is working with the Council for an additional amount to be added to the CIP for this
change.
As to the conditions - A, B, and C are being complied with (the Water Commitment Deposit
was paid May 29, 2003).
Condition D allows for five years to complete the conditions and we are in compliance with it
by virtue of the current timing.
Conditions E and F, in reference to roadways, are being planned according to the
requirements of the conditions.
Condition G regarding drainage is being engineered by a licensed civil engineer. Our
NPDES permit has been approved pending one letter from Public Works to the
Environmental Management Division of the State Department of Health.

Traffic Impact Report, have been ordered and were in progress through our traffic study
consultant/engineer, Warren Yamamoto. Currently, these have been tabled until we make a
final decision for the location of the fire station.
Condition L is being executed by way of coordinated planning between the Fire Chief and the
Fire Station architect, Russ Oda.
As our plans come to fruition for the fire station and the possible affordable residential
apartments, we shall work out the interior design details to comply with Conditions M, N, and
O, and Q.
Condition P has already been reviewed and cleared.
Condition R, regarding a future Unified Impact Fee Ordinance, is being mitigated by
Corporate Council for credits with the Fire Station.
Condition S refers to this subject Annual Report.
Condition T for time extensions, is not applicable at this point, and hopefully, will not be
needed.
And finally, we submit this report to comply also with Condition U for timely compliance. We
apologize to the Director and the Council for surpassing the one-year target of the effective
date, again, as one year seems to fly by quickly, especially when there is so much activity,
on the drawing board and in the planning and strategies for this project.
