AN ORDINANCE AMENDING CHAPTER 18, OF THE HAWAII COUNTY CODE 1983
(1995 EDITION), RELATING TO PUBLIC TRANSPORTATION.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 18, Article 4, Division 1, Section 18-90, (Fares), of the
Hawaii County Code 1983 (1995 edition), is amended by adding a new subsection to
read as follows:
f q) Promotional fares. The Transit Administrator may establish fares on a
temporary basis for a period not to exceed 90 (ninety) calendar days for bus
routes and services.
(h) Kona district transportation free zone.
(1) The purpose of this subsection is to assist in alleviating traffic
congestion in the Kona district.
(2) The Kona district between Kealia (Fuiihara Store), and Kalaoa
(Makalei Golf Course Road), shall be a transportation free zone.
Riders boarding and alighting any public transit vehicle operated by
the County of Hawaii or its designee within the two areas shall ride
free of charge.
(3) The transportation free zone shall not apply to County contracted
shared-ride taxi services, Countv operated curb to curb van
services, or Countv operated non-scheduled bus services.
(4) This subsection shall terminate two years after approval. Prior to
its termination, the Transit Administrator shall report to the Hawaii
County Council on the impact of its implementation.
SECTION 2. Material to be repealed is bracketed. New material is underscored.
In printing this ordinance, the brackets, bracketed material and underscoring need not
be included.
SECTION 3. If any provision of this ordinance, or the application thereof to any
person or circumstance, is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application, and to this end, the provisions of this ordinance are declared to be
severable.

SECTION 4. This ordinance shall take effect upon its approval.
