Re: Resolution Adopting USDA Form Resolution for USDA Rural Utilities Service Grant/Loan
Financing of the Happy Homes Subdivision Public Waterline Replacement Project and
Related Matters
Enclosed is a resolution that authorizes the adoption of a USDA Rural Utilities Service "Form
Resolution" required for the loan closing actions now underway to complete the financing of the
Happy Homes Subdivision Public Waterline Replacement Project.
Correspondence dated August 30, 2004 from the USDA Office of the General Counsel in San
Francisco indicates that adoption of this resolution is required per closing instructions to USDA's
Rural Utilities Program Director in Hilo. In response, our Legislative Auditor's Office, Honolulu
bond counsel attorney, and Office of the Corporation Counsel have collaborated to bring this
measure forward to assure that all loan/grant closing actions involving USDA are completed
before the loan closing deadline of October 20, 2004. It is critical that this measure be favorably
adopted to secure the $259,200 in federal loan financing and the $777,500 federal grant
underwriting this project. This resolution is patterned after Resolution 239-04, which was
adopted by the Council on September 15, 2004 for the Kona Coastview and Kona Wonderview
Subdivisions.
Due to the urgency of this matter, I would like to request a waiver from the Finance committee
and have this resolution heard at the Council meeting scheduled for October 4, 2004.

RE: Resolution No. 247-04 Adopting USDA Form Resolution for USDA Rural
Utilities Service Grant/Loan Financing of the Happy Homes Subdivision Public
Waterline Replacement Project and Related Matters.
Pursuant to Section I (g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
