This is a partial response to your letter dated June 14, 2004 requesting that lands donated to the
Office of Housing and Community Development and Hawaii Island Community Development
Corporation for roadway and drainage purposes be considered for partial compliance of
Condition Q (fair share contribution) regarding roadway and traffic improvements. We will
consider the donated lands for roadway and drainage purposes for partial compliance with
Condition Q regarding roadway and drainage purposes. Please submit information regarding
identification and market value of the donated lands for consideration.

Compliance with Conditions
Dear Mr. Yuen:
Your letter of May 5, 2004 acknowledged receipt of our annual report and clarified conditions
that we have complied with. I have also met with Ms. Alice Kawaa of your office to clarify the
amounts due for our fair share contributions.
She has informed me that the following amounts are attributable to this development based on the
adjustments to the percentage change in the Honolulu Consumer Price Index. I have broken that
out to determine amounts due for each service area for the first phase of 49 units and the full build
out of potentially 225 units. We understand per condition "Q" that these amounts are due and
payable at the time of Final Subdivision Approval for each phase of development.

We have been assigned 49 units of water from the Department of Water Supply for our first phase
of development. We understand that any additional development would require that we post a
surety or other security deemed acceptable by the Director for the development of a water source
for the additional units under condition "C". No such surety or security is required for the initial
49 units in phase 1 as DWS has already assigned units for this phase.

Your letter of May 5, 2004, also agreed to the satisfaction of condition "L" by the creation of a
play court, such as a basketball court, located near the Ouli self-help housing project and the
donation of land set aside for a manager's unit for the County's rental project at Ouli. We will
contact the Department of Parks and Recreation and develop a formal recreation plan in
consultation with the Office of Housing and Community Development. This plan will be
submitted for your review and approval.
In addition the owner is working with the Office of Housing and Community Development and
Hawaii island Community Development Corporation to identify and donate land they have
requested for roadway and drainage purposes. We request that you consider tyiis potential
donation when considering compliance with condition "Q" related to roadway and traffic
improvements.
I believe this accurately reflects our discussions to this date related to compliance with the
conditions of approval. Should you or your staff have any questions, please contact me directly.
