Subject: Compliance with Condition 1 of the March 27, 2002 Letter TMKs: 6-2-01:19; 6-7-01; Portion of 25; 6-7-02: 09, 48 and Portion of 17, and 6-8-01: Portions of 1 & 8 This is in response to your letter dated September 16, 2004 regarding Condition No.I our March 27, 2004 letter. We acknowledge that your letter will assure that a maintenance program will be implemented for the grass swales within Luala'i in compliance with Condition No. 1. We have need of the following to fully comply with the conditions of our letter: Condition No. 3: The covenants shall inform buyers of the residential units where the grass swales are proposed that the County shall not be responsible for providing sidewalks within this area in the future. If future improvements or sidewalks are desired, the residents shall be responsible for the costs of the improvements. We need a copy of these covenants for approval by the Planning Director, in consultation with the Department of Public Works. Again, once we receive the above listed information, we will recommend council acceptance of the road with a private maintenance program for the grass swales. This letter will confirm that either the developer of Luala'i, Kaomalo LLC [a joint venture between D.R. Horton-Schuler Division and Parker Ranch] or the Luala'i Homeowners' Association will maintain the grass- swales within Luala'i, in perpetuity.
