Dear Chair Elarinoff and members of this Committee:
Subject: Communication 770 (Bill 327) - Kona Oasis, Inc.
TMK: 7-5-09: 40
This is to follow up on my letter of September 28, 2004 regarding the subject
matter. Inasmuch as neither the applicant nor I will be able to attend this meeting, we
would like to share our thoughts on potential questions that may arise relating to the bill's
conditions.
1. Relative to Condition D-2, I am attaching a sketch of the alternative
access schemes (A, B, and C) that have been reviewed by the Department
of Public Works and representatives of the neighboring projects for your
information. Schemes B and C are somewhat similar, except that C was
slightly adjusted by pushing the improvements further mauka within the
existing right-of-way. All these alternatives are acceptable to the
applicant, but we will defer to the County as to which one works best.
Please note that as the attached letter indicates, the DPW prefers Scheme
C.
2. Condition L requires a fair share contribution. This contribution does not
provide for any "credit" for improvements that applicant will have to
make along the property's Alii Drive, Walua Road, and Kuakini Highway
frontages. As such, the second sentence of Condition F may be
superfluous, as the County would already be in a position to collect the
required impact fee and utilize same for other roadway improvements in
the general area.
3. Relative to Condition H, please note that the archaeological survey and
mitigation plan has been approved by the State. There is a platform on the
site that will be preserved. The mitigation plan called for a data recovery
of one of the sites. The data recovery was recently completed, and no
burial was confirmed. The State's letter approving the mitigation plan is
enclosed.
4. In relation to Condition P relating to time extensions, it is our
understanding that in situations where there have already been extensions

granted, there can be no more administrative extensions. As such, as in
this case, any and all subsequent extensions would have to be approved by
the County Council.
5. Finally, we note that the proposed conditions also cover a requirement to
comply with the County's affordable housing code, as well as the
imposition of a fair share contribution. Given the infrastructure and
affordable housing concerns, this is understandable. However, the
applicant requests that in the interest of equity, this - as well as the
requirements noted above - be uniformly applied in similar situations.

Plan for SIHP Site Ilos9, Feature 7" (Deselits and Rechtman, June 2004)

Thank you for your cover letter dated June, 28, 2004, and the opportunity to review and comment au the
above mentioned report, prepared for Mr. Ali Ghalamfarsa, Ali! Architects, Inc,
The plan describes data recovery proposals for Site 11039, Feature 7, a plattbrm identified in an
Archaeological Inventory Survey of the subject parcel (Clark and Rechtman, 2003), A total of eight
features were described in this survey, two of which are to be preserved (Feanues 2 and 3). Feature 7 was
interpreted by Welch (1988) as a possible shrine or burial, yet test excavations at the feature did not detect
a burial and material evidence to support its tlnretion was not conclusive. As cited in your plan, Wickler
(19916) offered additional information to refute the burial interpretation, Tha investigation of this feature
during data recovery was approved, therefore, with your recommendation that any human remains located
during these excavations will be treated as "previously identified" aril treannent proposals will be
presented to the Hawaii Island Burial Council.
The research goals of this plan are to refine the functional interpretations previously offered for the
feature and to establish the timing of its construction and duration of use. The 100% sampling strategy
proposed will add significantly to our understanding of the construction of these types of platforms and
allow for maximum consideration of its potential burial function. You propose excavation in a series of
stages, beginning with the exposure of a cross-section of the entire feature.
We suggest one addition to this strategy that might reveal any architectural features such as alignments
that might be presently obscured by the surface paving-perhaps you could consider stripping the surface
of its pavement prior to initiating your cross-section excavation. In addition, as you have done in the past,
we ask that you contain the soil extracted from your excavation units and set aside your surface pavement
stones, such that if restoration of the feature becomes necessary you might achieve this as accurately as
possible.

Your plan is considered adequate to meet the requirements of HAR 13 013.278 and work may continence
at the site. Kindly notify our Kona staff when you commence work, as we may like to visit the site as
work progresses.
