RE: Bill 248, Draft 3 -University Terrace Project
Attached for your review and transmittal is the above bill. At the Council's Planning
Committee meeting held October 5, 2004, Bi11248, Draft 2 was amended with the
following:
NN. [Any contributions required by this ordinance that exceed the fair share
requirement of this proposed development shall, at the applicant's request be
credited towazds any of the applicant's future developments that require
infrastructural impact contributions.] The applicant shall be given credit
against the fair share assessment for any improvements to the road system in
the immediate vicinity (Komohana Street, Mohouli Street, and Kaumana
Drive) to mitigate deficiencies that would have occurred without the proiect,
as identified in the revised TIAR.
PP. [Comply with all other applicable laws, rules, regulations and requirements
of other affected agencies.] The applicant shall comply with all applicable
County, State and Federal laws, rules, regulations and requirements.
Please have this item referred to the next Planning Committee meeting for consideration.
