Hi, Mr. Tyler:
1. I've been going thru Jai's questions. Most of them are technical, and are in relation to interpretation and enforcement,
not the drafting of the proposed bill.
2. If you choose to do so, the following amendments are in red:
A. p.3, 3-3(a)(1), Aerial Sign: add "balloon used as a sign, or an airplane banner"
B. p.5, 3-3(a)(25), Portable Sign: delete "balloons used as signs" (clarifying a balloon is an aerial, not portable,
sign)
1) Jai also suggests deleting regulating "signs attached to vehicles because it is too difficult to enforce
A. p.6, 3-3(a)(28), Sign: to clarify this does not apply to the street addressing requirements of Chapter 14, aka
"house numbering bill," Ordinance #04-82, enacted 7-15-04
B. p. 6, 3-3(a)(28), Sign: to clarify this does not apply to sculpted ornamental shrubbery or ground cover (such
as the sculpted shrubbery saying "PKP" alongside the highway at Prince Kuhio Plaza or the "Nani Mau"
shrubbery)
C. p.8, 3-5, Multi-faced Signs: add #b for "spherical orthree-dimensional signs" (such as a balloon)
1) Question: Is the intent to regulate the "Union 76" gas station rotating spherical sign?
If yes, what category of sign is it considered?
2) The actual formula to compute the surface area of a sphere is: 4 pi x radius squared
That's too complicated, so I put in a "formula" which does not directly correspond to the true formula.
3. Brian Kajikawa also suggests:
A. p. 6, 303(a)(28),line 11 of "Sign": delete "flags"
Enforcement would be difficult. Example: If McDonald's takes down its M flag nightly.
Is that a permanent sign? Temporary?
4. Temporary Banners, p. 11, 3-9(a)(1)
A. Current sign code 3-32(b) requires anyone who wants to erect a temporary banner OVER a street must show
proof of insurance, and name the county as an additional insured. Chapter 22-3.4(2) also requires the written
consent of every property owner directly fronting the proposed banner site.
B. This insurance requirement has been deleted from the proposed sign code (during the numerous drafts).
Was this intentionally omitted, or just an oversight?
C. I agree with Galen Kuba's input that "Banners" should be addressed in the Sign Code, rather than in Chapter 22
"Streets & Sidewalks," especially for the lay person who is looking for the relevant code section.
D. Do you want to amend Section 3-9 to include the 1) insurance requirement and 2) all the requirements now
set forth
in Chapter 22?
