Subject: Bill 175, Draft 3, Real Property Taxes Relating to Real Property Assessment,
which the 3% growth cap applies. (Replaces Amendment Letter of October 14,
2004)
This letter replaces my previous amendment letter of October 14, 2004. I have further amended
item numbered 4 and 7 and added 10 as follows
1. Page 1, Section 19-53(a). Amends by deleting [aid-~eq~al~isecl] and replaces it with fair and
consistent. "...as far as possible, uniform, fair and consistent assessment...".
2. Page 1, Section 19-53(a)(1). Deletes [i~g] and replaces it with Improvements.
3. Page 1, Section 19-53(a)(2). Replaces [bxil~xg] and replaces it with i~rovements.
4. *Page 2, Section 19-53(b). Amends to read as follows: "So far as practicable, records shall
be compiled and kept by the director, which shall show the methods established by law [cam
for the determination of values."
5. Page 2, Section 19-53(c). Adds to the end of the sentence "in accordance with its actual
use".
6. Page 2, Section 19-53(e)(1). Amends to read as follows, "...highest and best use within each
class".
7. *Page 3, Section 19-53(e)(2)(A)(iii). Adds to the end of the sentence "except as ft~rev-ided
pex~itted-er1 exempted under sections 19-'71(a) or (b)".
8. Page 3, Section 19-53(f). Amends to read as follows, "...considered to have special
knowledge of agricultural land values and uses."
9. Page 6, Section 19-53(g), first sentence. Deletes [~iidit~gs] and replaces it with
improvements.
10. *Page 5, Section 19-53(f)(4)(B), second sentence. Amends to the to read as follows, "the
land maybe returned to its [deserted] actual agricultural use [fie] or it shall be
assessed and taxed at market"
