This annual report is being submitted to inform you of the status of the Hokukano Ranch
Visitors' Center development and to provide an update on the extent to which conditions
of approval for the above-referenced ordinance have been satisfied. Please accept our
apologies for the tazdiness of the filing of this report. Future annual reports will be
submitted prior to We June 18a' anniversary date of the enactment of the ordinance.
Condition A: Hokukano Ranch, Inc. will comply with all the stated conditions of
approval.
Condition B: Hokukano Ranch, Inc. will not exceed the maximum daily water usage
requirements as determined and established by the Department of Water
Supply. As none of the planned renovations or new construction
associated with the Visitors' Center has yet taken place, water usage on
the property has not increased.
Condition C: Hokukano Ranch, Inc. intends to complete the development of the
Visitors' Center within five years from the effective date of Ordinance No.
03 93. Hokukano Ranch, Inc. will secure Final Plan Approval from the
Planning Drector prior to the commencement of any renovation and/or
construction activities within five years from the effective date of the
ordinance.
Condition D: Hokukano Ranch, Inc. will obtain a letter from the State Historic
Preservation Division (SHPD) confirming that progosed activities within
[he project site will have "no adverse effect" upon historic properties. If
SHPD will not issue a "no adverse effect" letter prior to Final Plan
Approval, Hokukano Ranch, Inc. will prepare an azchaeological inventory
report and mitigation and preservation plan for approval by the Planning
Director, in consultation with SHPD.

Condition E: Hokukano Ranch, Inc. acknowledges that in the event the project site
development is altered and no longer constitutes a visitors' center that is
substantially similaz to representations made within the change of zone
application, it will be required to submit a revised Traffic Impact Analysis
Report (TIAR) for review and approval by the Department of Public
Works. At this time, Hokukano Ranch, Ina intends to develop the
Visitors' Center as originally presented.
Condition F: Hokukano Ranch, Inc. acknowledges that in the event the project site
development is altered and no longer constitutes a visitors' center that is
substantially similar to representations made within the change of zone
application, it will be required to submit new plans and water demand
calculations to the Department of Water Supply for review and approval.
As stated above, Hokukano Ranch, Inc. intends to develop the Visitors'
Center as originally presented.
Condition G: Hokukano Ranch, Inc. is in the process of preparing a flood study of the
project site as required by this condition. At present, inclement weather
has been delaying an aerial survey which will provide topographic data
necessary for the completion of the flood study. Once the flood study is
completed, it will be submitted for review and approval by the Department
of Public Works. Hokukano Ranch, Inc. acknowledges that, if required by
the Department of Public Works, it will submit a Letter of Map Change to
the Federal Emergency Management Agency (FEMA) prior to the
issuance of a Certificate of Occupancy for any portion of the proposed
commercial development.
Condition H: Hokukano Ranch, Inc. will dispose of all development generated runoff on
site and will not duect runoff toward any adjacent properties. Hokukano
Ranch, Inc. will prepare a drainage study of the project site for review and
approval by the Department of Public Works prior to the submittal of
plans for subdivision review. Drainage improvements, if required, will be
constructed or bonded meeting with the approval of the Department of
Public Works prior to the issuance of Final Plan Approval.
Condition I: Hokukano Ranch, Inc. will secure the approval of the Department of
Public Works for driveway connections from the project site to
Mamalahoa Highway and Konawaena School Road. Hokukano Ranch,
Inc. acknowledges that access to or from Mamalahoa Highway will be
limited to right-turn movements only unless modified with the approval of
the Department of Public Works. As stated above, Hokukano Ranch, Inc.
intends to develop the Visitors' Center as originally presented. As such, it
is not anticipated that a revised TIAR will be required.

Condition J: Hokukano Ranch, Ina will improve the project site's frontage along
Mamalahoa Highway and Konawaena School Road with pavement
widening and transitions with curb, gutter, sidewalk, drainage
improvements and any relocation of utilities in a manner meeting with the
approval of the Department of Public Works. Hokukano Ranch, Inc, will
complete these roadway improvements pursuant to a schedule meeting
with the approval of the Department of Public Works and the Planning
Department.
Condition K: Hokukano Ranch, Inc. does not intend to subdivide the project site into
smaller lots in accordance with the CV-10 zoning. Nonetheless,
Hokukano Ranch, Inc. acknowledges that should such subdivision action
be contemplated, direct access from proposed individual lots to
Mamalahoa Highway will be prohibited.
Condition L: Hokukano Ranch, Inc. will submit a Solid Waste Management Plan for the
development to the Department of Environmental Management for its
review and approval. Hokukano Ranch, Inc. will submit a copy of the
approved plan to the Planning Department prior to the issuance of Final
Plan Approval.
Condition M: Hokukano Ranch, Inc. does not intend to develop residential uses on the
subject property. Nonetheless, Hokukano Ranch, Inc. acknowledges that
should such use be established within the 5.595-acre project site,
maximum density will not be allowed to exceed 16 residential units.
Condition N: In the event that any rc±ma;nc of historic sites are encountered on the
project site, Hokukano Ranch, Inc. will cease work and immediately
notify the State Historic Preservation Division. Hokukano Ranch, Inc.
will not resume work until SHPD issues an archaeological clearance.
Condition O: Hokukano Ranch, Ina will comply with all applicable laws, rules,
regulations and requirements of the affected agencies for approval of the
proposed development within the subject properly.
Condition P: Hokukano Ranch, Inc. acknowledges that should the County Council
adopt a Unified Impact Fees Ordinance setting forth criteria for imposition
of exactions or the assessment of impact fees, conditions included within
Ordinance No. 03 93 will be credited towazds the requirements of the
Unified Impact Fees Ordinance.

Condition R: Hokukano Ranch, Inc. acknowledges the circumstances under which the
Planning Director may grant an initial time extension for the performance
of conditions within Ordinance No. 03 93. Hokukano Ranch, Inc. will
comply with Condition R.
