ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 18, OF THE HAWAII COUNTY CODE 1983
(1995 EDITION), RELATING TO PUBLIC TRANSPORTATION.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 18, Article 4, Division 1, Section 18-90, (Fares), of the
Hawaii County Code 1983 (1995 edition), is amended by adding a new subsection to
read as follows:
(q) Promotional fares.
(1) The purpose of this subsection is to provide lower bus fares when a
new route or service is provided or to boost ridership on established routes.
(2) The Transit Administrator may establish fares on a temporary basis
for a period not to exceed 90 (ninety) calendar days for bus routes and services.
L) Transportation kokua zone.
(1) The purpose of this subsection is to boost ridership in economically
depressed districts and to assist in alleviating traffic congestion in
various districts The Council may upon consultation with the
transit administrator establish a transportation kokua zone. Riders
boarding and alighting any public transit vehicle operated by the
County of Hawaii or its designee within a transportation kokua
zone shall ride free of charge.
(2) The following areas shall be designated a transportation kiikua
zone:
(A) The "Kona district zone" between Hawaiian Ocean View
Estates/Hawaiian Ocean View and Kawaihae.
(B) The "Puna district zone" between Pahoa and Hilo.
U The transportation kokua zone shall not apply to County contracted
shared-ride taxi services, County operated curb to curb van
services, or County operated non-scheduled bus services.
(4) A designated transportation kokua area shall terminate two years
after its implementation, unless extended or terminated by the
Council.
U Within one year of the date of the implementation and again not
later than 90 days prior to termination of the transportation kokua
zone the Transit Administrator shall report to the Hawaii Countv
Council on the impact of its implementation at which time the
Council may extend or terminate the established zone(s).
SECTION 2. Material to be repealed is bracketed. New material is underscored.
In printing this ordinance, the brackets, bracketed material and underscoring need not
be included.
SECTION 3. If any provision of this ordinance, or the application thereof to any
person or circumstance, is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or

application, and to this end, the provisions of this ordinance are declared to be
severable.
SECTION 4. This ordinance shall take effect upon its approval.
