HomeMy WebLinkAboutRES 264 Draft 01 2002-2004 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 264 Q4 A RESOLUTION AFFIRMING THE CONTINUED CIVIL SERVICE STATUS OF CERTAIN POSITIONS IN THE OFFICE OF THE COUNTY CLERK/COUNCIL. WHEREAS, in 1977, the State Legislature enacted Act 62, which amended Section 46-32, Hawai i Revised Statutes, by stating, in part, "the council of any county may appoint and employ personnel as it deems necessary and prescribe their powers, duties and compensation. All such personnel shall be exempt from the civil service and the position classification plan;" and WHEREAS, in 1977, all council employees were civil service with the exception of the county clerk, the deputy county clerk and the legislative auditor; and WHEREAS, as a result of Act 62, the Council subsequently converted some positions from civil service to exempt, created additional exempt positions, and retained several positions as civil service; and WHEREAS, prior to 1977 and continuing to present, the Office of the County Council/Clerk's Office has been staffed, in part, by the following civil service personnel: the council services supervisor positions (Position Nos. 1912 and 2445), council services assistant positions (Position Nos. 1957, 2448, 2570, 2633, 3861), and the legislative information and reference technician (Position No. 2280); and WHEREAS, these positions provide essential secretarial, informational and reference services to the Council and the Clerk as well as to other government agencies and the general public; and WHEREAS, these positions are, at the minimum, responsible for: • Complying with legal posting, notice and mailing requirements of the Sunshine Law; • Assisting in the proper preparation of council and committee agendas; Securing meeting facilities accessible for persons with physical disabilities; Making arrangements upon request for persons who need special accommodations at meetings; preparing council and committee minutes by the statutory deadline; Assuring the timely filing of financial disclosures required by law; Disseminating the Hawaii County Code and its supplements; Processing administrative rules of procedures with the Lieutenant Governor's Office, executive orders filed with the County Clerk, lobbyist registration and expenditure reports and claims against the County filed by law with the County Clerk; Recording appropriate deeds with the State Bureau of Conveyances; Maintaining and managing the Clerk's Office records system; and WHEREAS, these positions in the County of Hawai i have customarily and historically been performed by civil servants; and WHEREAS, the Council finds that it is imperative to have experienced, qualified clerical and technical resource staff that provide continuity and institutional knowledge to the Office of the County Clerk/Council; and WHEREAS, the Council further finds that it is in the public interest and in the best interest of the Council to retain the civil service status of these positions and to continue to fill these positions through the merit system. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it affirms the civil service status of Position Nos. 1912, 2445, 1957, 2448, 2570, 2633, 3861, and 2280 in the Office of the County Clerk/Council. BE IT FURTHER RESOLVED that it expresses its deepest respect and appreciation for the dedicated work performed by present and past employees in these positions. BE IT FINALLY RESOLVED THAT the Clerk of the Council transmit a copy of this resolution to Director of Personnel Michael Ben and the HGEA-Hawaii Branch.
