HomeMy WebLinkAboutRES 262 Draft 01 2002-2004 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 26Z (?4 RESOLUTION AUTHORIZING THE (I) EXTENSION OF THE PUBLIC SEWER FROM ALIT DRIVE MAUKA AND ACROSS WALUA ROAD; AND (2) REIMBURSEMENT FOR THE COST OF CONSTRUCTION OF THE EXTENSION BY BOLTON, INC. AT WAI'AHA, NORTH KONA, HAWAII. WHEREAS, applicant Bolton, Inc. has submitted an application to extend the public sewer from Ali'i Drive mauka across Walua Road in accordance with Section 21-26, Hawaii County Code, with said application and construction plans being attached hereto as Attachment "A' ;and WHEREAS, sewer extensions aze beneficial to the community by eliminating existing cesspools and reducing the amount of pollutants reaching the groundwater and the coastal waters, resulting in cleaner, healthier envirorunent; and WHEREAS, Section 21-26, Hawaii County Code, requires that all sewer extensions shall be approved by resolution of the County Council, and WHEREAS, applicant, Bolton, Inc., has proposed to construct the extension in accordance with Section 21-28(a) Hawai i County Code, regarding payment of costs; and WHEREAS, the Director of the Department of Environmental Management has already approved the plans for the extension; and WHEREAS, in accordance with Section 21-28(a), Hawaii County Code, the applicant may receive for ten years afrer completion of the extension one-half of all moneys for sewer chazges collected by the County from other properties connecting to the extension, provided the total of such reimbursements shall not exceed the cost incurred by the applicant to construct the extension, and plans to reimburse applicant for construction of sewer extensions shall require the approval of the County Council by resolution. NOW, THEREFORE, BE IT RESOLVED by the Council of the County of Hawaii that the sewer extension from Ali'i Drive mauka across Walua Road by Bolton, Inc. is hereby approved. BE IT FURTHER RESOLVED that the request of Bolton, Inc. to be reimbursed for the cost of the sewer extension from Ali'i Drive mauka across Walua Road in accordance with Section 21-28(a), Hawaii County Code, is hereby approved. 1$E IT FURTHER RESOLVED that the Clerk of the County of Hawaii transmit copies of this resolution to the applicant and the Departments of Finance, Public Works and Environmental Management.
