Attached please find a Resolution Requesting the Supreme Court of the State of Hawaii to
Render an Expedited Decision in the Appeal of Civil No. 00-1-0192K, Walter John Kelly et. al.
vs. 1250 Oceanside Partners et. al.
The intent of this resolution is to express the Council's interest in a prompt, clear, conclusive and
conciliatory resolution to this very significant lawsuit.

SUBJECT: Request to Waive A Resolution Requesting the Supreme Court of the
State of Hawaii to Render an Expedited Decision in the Appeal of Civil
No. 00-1-01921-, Walter John Kelly et. al. vs. 1250 Oceanside Partners et. al.
Pursuant to Section I(g) of Rule 4 of the Procedure of the Council of the County of Hawaii, I
request your support for waiver of this matter in order that the Council's action, if favorable, may
be forwarded to the Hawaii Supreme Court in tandem with other amicus briefs and filings
associated with the appeal discussed in this resolution. It is therefore advantageous that approval
is granted and the matter placed onto the next Council agenda (November 10, 2004) for review.
However, in the event this request is denied, for whatever reason, I understand the matter shall
be referred to the Planning Committee for placement on its future agenda.
