Pursuah 'to my letter of August 26, 2004 that responded to your mandate to work out a resolution
with ~ uncil Iviember Curtis Tyler on the sale of the subject roadway remnant, may I
respect y submit that no viable resolution has been reached to date. The subject parcel is a
thin stri of land about 150 feet along the rnakai side of Alu Drive tapering from five feet to 1.96
feet in "dth. It contains a land area of 909 square feet. As mentioned Curtis prefers to grant
Mr. Ber~ech easements for the following:
. His existing driveway, being approximately 15 feet wide
. His existing water line connection to the rrreter on Alii Drive
. His existing sewer connection to Alu Drive
. His existing overhead electric, telephone and cable T"V" lines

County 'o hiereof includes ongoing liability and maintenance on a useless parcel of Lurd.
Wht7e ~ ponder (this matter, please recall that Mr. Benech has been "landlocked" for almost two
years. cannot sell his lot nor borrow against it. He additionally has expended considerable
legal and consulting fees to rectify this situation, inclusive of all survey costs to date. He also
has to purchase the remnant from the County at appraised value. I personally would not
buy the bject parcel at S30 per square foot because it affords no benefits other than those
already ' existence for over 47 years. Mr. Benech also will assume mainnenance and liab~ity
thereaR He can do no store. This situation begs for affirmative resolution before it becomes
a legal p oblem. I ask each council member to consider what he or she would do if this
happen to one of them I believe they would be outraged. In today's West Hawaii real estate
market, enial of Mr. Benech's right to sell or finance his property is risky business.

Resoluti n 227-04 be reviewed by the entire Finance Committce in the neaz future so the mattet
may mo a one way or the other before the Council I believe that once the practicalities of
granting four easernertts over an already small parcel of land is considered by each Finance
Commitilt ~atber, they will agree with the position of DPW, Finance, Mr. Benech, and myself.
In clo ' , Mr. Benech owns three other parcels of land in Hawaii County and is most certainly a
tax Hawaii County land owner worthy of relief. I respectfully request the County
