AN ORDINANCE TO INITIATE A CHARTER AMENDMENT TO THE HAWAII COUNTY
CHARTER (2000), RELATING TO ARTICLE III, SECTION 3-2, COMPOSITION AND
TERMS OF ELECTED MEMBERS OF THE COUNTY COUNCIL
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Intent and Purpose. The purpose of this amendment is to increase the eligibility
of members of the Hawaii County Council to hold office for up to, but no more than, six consecutive
terms, or twelve years. While retaining the principle of tern limits, this amendment is intended to
facilitate lengthier careers for county legislators, subject to the will of the voters, and, thereby, avail the
electorate and county government with the perspective and experience to effectively address ongoing
and longstanding issues and concerns deemed important to the people of the County of Hawaii.
SECTION 2. Article III, Section 3-2, "Composition and Terms," of the Hawaii County Charter
relating to consecutive term limits of members of the County Council, is hereby amended as follows:
"Section 3-2. Composition and Terms. There shall be a County Council composed of nine
members. One member shall be elected from each of nine districts. The terms of the council
members shall be two years and shall begin at twelve o'clock meridian on the first Monday of
December after the election. The terms of the council members shall not exceed [four] six
consecutive two year terms. Candidates shall be elected in accordance with the election laws of
the state, insofar as applicable. (Amended Gen. Elec. 1996 and 2000 Charter Amend. 1)"
SECTION 3. Implementation and Effective Dates of Term Limits. Upon adoption of this
charter amendment and its approval by the voters in the next 2006 general election, the amendment shall
be implemented and shall apply to incumbent council members as follows:
An incumbent council member elected in 1994 and who serves six consecutive two year
terms thereafter shall be subject to term limits at the expiration of his/her 2004-2006 council
term and shall not be qualified to be placed on the 2006 primary and general election
ballot(s) for election to the County Council;
An incumbent council member elected in 1996 and who serves six consecutive two year
terms thereafter shall be subject to term limits at the expiration of his/her 2006-2008 council
term and shall not be qualified to be placed on the 2008 primary and general election
ballot(s) for election to the County Council;
An incumbent council member elected in 1998 and who serves six consecutive two year
terms thereafter shall be subject to term limits at the expiration of his/her 2008-2010 council
term and shall not be qualified to be placed on the 2010 primary and general election
ballot(s) for election to the County Council;
4. An incumbent council member elected in 2000 and who serves six consecutive two year
terms thereafter shall be subject to term limits at the expiration of his/her 2010-2012 council
term and shall not be qualified to be placed on the 2012 primary and general election
ballot(s) for election to the County Council;
5. An incumbent council member elected in 2002 and who serves six consecutive two year
terms thereafter shall be subject to term limits at the expiration of his/her 2012-2014 council
term and shall not be qualified to be placed on the 2014 primary and general election
ballot(s) for election to the County Council;
6. An incumbent council member elected in 2004 and who serves six consecutive two year
terms thereafter shall be subject to term limits at the expiration of his/her 2014-2016 council
term and shall not be qualified to be placed on the 2016 primary and general election
ballot(s) for election to the County Council;
SECTION 4. Material to be deleted is bracketed. New material is underscored. In printing this
ordinance, the brackets, bracketed material, and underscoring need not be included.
SECTION 5. Upon adoption of this ordinance, this council, by appropriate resolution shall
provide that this amendment be submitted to the electorate of the county for approval at the next general
election.
SECTION 6. If any provision of this ordinance, or the application thereof to any person or
circumstance, is held invalid, the invalidity does not affect other provisions or applications of the
ordinance which can be given effect without the invalid provision or application, and to this end, the
provisions of this ordinance are declared to be severable.
SECTION 7. Effective Date. This amendment shall take effect immediately upon its approval
by the voters in the 2006 general election.
