We apologize for the late response to your letters. Your first letter was received at this
office on May 24, 2004 (the letter was not dated). Your second letter was dated June 21,
2004 and was received on June 28, 2004. We thank you for the information as to who is
currently residing on the subject property.
When our zoning inspector conducted his initial site inspection on April 15, 2004, the
individual our inspector spoke with refused to relinquish his name. Follow-up site
inspections were conducted on July 28, 2004, September 22, 2004, and November 3,
2004. During the July 28, 2004 inspection, the tent was torn down and folded, but
remained on the subject property. The occupants were beginning to erect a wooden
8'x10' structure. Verification o I a building setback violation could not be determined at
that time.

During the September 22, 2004 follow-up site inspection, our inspector observed that the
8'x10' wooden structure was still under construction. Our inspector could not verify if
this unpermitted structure was being constructed within the required minimum eight (8)
foot side yard (setback). On November 3, 2004, our inspector found front and rear
property pins with a nylon cord tied to each pin. Our inspector measured a distance of
eight (8) feet from that line to the wall of the unpermitted structure and verified that this
structure was not being erected within the side yard (setback). Therefore this Alleged
Zoning Violation file is being closed.
There still may be building violations. According to the Department of Public Works-
Building Division, a building permit was not issued for any structure on the subject
property. A copy of this letter will be forwarded to the Department of Public Works-
Building Division, as well as to the Department of Health, and the Real Property Tax
Office for their dispositions.
