Subject: Preliminary Comments on Hawaii County Council Change of Zone
Application (REZ 04-022) Comminication 848, Bill 367, Kona Hale Alii and
Request to Defer Action

This memorandum is submitted as testimony regarding Bill 1167. We regret we are unable to
deliver these comments personally and thank you for accepting them in written form
We respectfully ask that you defer action on this matter until our division has prepared a
comprehensive set of recommendations regarding the potential adverse effects on historic sites
by the proposed rezoning and planned development of the subject property.
The following illfacmatipn provides background information:
Our division has reviewed and approved an Archaeological Inventory Survey (Clark and
Rechtman, July 2004) for a 3.97 acre portion of the subject property that corresponds with the
planned development area. Mitigation commitments in the form of data recovery and ~ qg. I

preservation have been approved, and the applicant is moving forward toward the approval and
implementation of these plans for the development area only.
We understand that the applicant intends to commit the remainder of the subject property to
preservation in perpetuity, because a concentration of historic sites is known to be present on the
remainder of this property. These sites, which include burials and probable heimi were
documented in the late 1970's by Paul H. Rosendahl, but an Inventory Survey that meets current
Hawaii Administrative Rules standards has not been completed.
We applaud the applicant's intent the preserve these sites. However, our customary
recommendation to the Hawaii County Planning Department is that a comprehensive
Archaeological Inventory Survey of the entire property be undertaken for rezoning and
subdivision proposals as a precursor to such mitigation decisions. Of immediate concern for this
application is the proximity of the project area boundary to sites in the un-inventoried area that
may contain burials, and the lack of 6E-42 review process by which descendant families, the
Hawaii Island Burial Council, and our division may comment on the treatment of these sites.
A comprehensive inventory would pave the way for appropriate assessment of significance of
these sites, and appropriate preservation planning through the required Preservation Plan and
Burial Treatment Plan. These steps, if taken, will likely minimize future site management
difficulties.
Our full set of recommendations for both this proposed action and the planned consolidation and
resubdivision will be submitted in writing to Planning Director Yuen and to your committee
shortly. Thank you for your consideration.
