RE: unty Council Resolution 269.04
Dear hairman Arskaki and Council Members:
The Hawaii Island Economic Development Board (HIEDB) strongly supports
Resb 'on 269.04 requesting the Supreme Court of the State of Hawaii to expedite hearing,
the peal of the'Hokul's decision'.
As dearly spelled out in the Resolution, the Judgment and the Land Use Order have
had major negative impact on the economy, created great uncertainty and adversely,
imp the public confidence in the certainty of any land use approvals and permits
i by the County of Hawaii. It has also imposed a number of requirements and
cond one in the agricultural subdivision application process for lands within the State
Agri Itural'District which are not contained in the language and provisions of HRS Chapter
205, sing greater confusion.
This has caused great uncertainty and lack of confidence in the land use permit
sly in the County of Hawaii. Unless this matter is promptly addressed by the Court it will
Conti me to have adverse consequences for the entire business and investment community
as 1 as the County itself.
