Notice is hereby given that the Council's Committee on Finance will be holding workshops on Bill 49, Drag 3
(Comm. 118.6)_ an Ordinance amending Chapter 19, Articles I (Administration), 7 (Tax Maps; Valuations) and
8 (currently Reserved) of the 1lawai'i County Code 1983 (1995 Edition), relating to Real Property 'fax Definitions;
Non-Dedicated Agricultural Use Assessment and Agricultural Use Dedication.
Workshop Forma[: In order to promote a healthy exchange between Committee members, administration, and
members of the public, public comments will be encouraged throughout Committee discussion at the call of the Chair
rather than at the customary beginning of the workshop.
Generally, amendments proposed in this bill include, but are not limited to, the following:
(I) Adds agricultural-related definitions to clarify terminology.
(2) Clarifies the category of rmn-r/erlicotecl agricul/m~a/ else usses.cmeeels; requires property to be in certain
County zoning districts; changes the tax rollback period; and sets assessment at twice the dedicated
productivity value.
(3) Clarifies the category of uge~icah:mnl u.~~e decliculion by requiring new dedications be for 10 years and the
dedicated property he used for commercial purposes (gross revenues of $2,000/year); grandfathers
20-year agricuhural dedications: requires property to he in certain County zoning districts: changes breach
conditions adds breach exceptions; changes rollback period; and modifies the dedication period to allow
~armersh archers who lease their land to dedicate iC for the period of their lease if that period is al least
five wars.
