OIZDINANCE NO. ~
AN ORDINANCE AMENDING CHAPTER 24, OF THE HAWAII COUNTY CODE 1983 (1995
EDITION), RELATING TO VEHICLES AND TRAFFIC.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION I .The purpose of this legislation is to clarify the County's procedure for street
closures. The Council has been informed by the Police Department that dead-end streets, stub-outs and
other road terminus have attracted activities, such as loitering, littering, drinking and drug use, because
the streets have no immediate purpose or use. (n order to discourage illegal activities, the Council
believes that certain county-owned streets should be barricaded or blocked-off, provided notice is given to
adjacent property owners and closure does not affect the flow of traffic or public access. This measure
provides a framework by which certain streets can be closed by the Council for those specific reasons.
In addition, since the Police Department currently has permitting authority to close streets,
entirely or partially, for parades, processions or other special activities, this bill makes it clear that the
Department may also close time-limit parking stalls for the same purposes. Concurrently, the Council's
role in waiving enforcement of time-limit parking stalls would cover parking policy, not parades and
conventions.
SECTION 2. Chapter 24, article 7, division 3, section 24-153.3, of the Hawaii County Code
1983 (1995 edition), is amended to read as follows:
Section 24-153.3. [Permits.] Street closure.
~ No person shall block, close, restrict or i?npede the traffic on any street, highway,
[trafficway, causeway] time-limit parking stall or public right-of--way, for any
length of time for parades, processions or for any festive, religious, civic or other
special activity except in accordance with a permit issued by the chief of police or
[his] the chief's authorized representative and such other regulations as are set
forth herein. Such permits issued shall be immediately revoked at any time by the
chief of police or [his] the chief's authorized representative when there is reason
to believe that the activity is endangering any person, vehicle or property on or off
such street, highway, [trafficway, causeway,] time-limit parking_stall or public
right-of--way.
fib) The council by resolution. in consultation with the chief of police and the director
of public works, ma, authorize the temRorary closure of a roadway stub-out
dead-end and/or other road terminus when the following conditions exists:
The stub-out, dead-end or similar road terminus to be barricaded is
owned by the county.
The closure shall not affect the flow of traffic or public access.
Adjacent landowners are provided with written notification by the
requesting a~encv.
The closure is necessar~to prevent loitering. littering and other illegal
activities.
Removal of the temporary closure shall be authorized b~council resolution.
SECTION 3. Chapter 24, article 8, division 1, section 24-195, of the Hawaii County Code 1983
(1995 edition), is amended to read as follows:
Section 24-195. Time-limit parking zones.
(a) When official signs are erected giving notice thereof, no person shall stop, stand, or park
a vehicle for a period of time longer than that indicated on the signs, between the hours
indicated on the signs, on any day except Sundays and public holidays, upon any street or
portions thereof within the County.

(c) The areas of streets, described in schedules 30 through 33, sections 24-282 through 24-
285 are designated as time-limit parking zones when appropriate signs or markings
giving notice thereof are erected.
SECTION 4. Material to be repealed is bracketed. New material is underscored. (n printing this
ordinance, the brackets, bracketed material and underscoring need not be included.
SECTION 5. If any provision of this ordinance, or the application thereof to any person or
circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the
ordinance which can be given effect without the invalid provision or application, and to this end, the
provisions of this ordinance are declared to be severable.
SECTION 6. This ordinance shall take effect upon its approval.
