ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 20, ARTICLE 4, HAWAII COUNTY CODE,
1983, AS AMENDED, RELATING TO SOLID WASTE DISPOSAL FEES.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. The Council of the County of Hawaii finds that allowing
commercial solid waste haulers to receive partial disposal fee credit for residential waste should
be a requirement set forth in the Hawaii County Code rather than a provision to be
discretionarily included in administrative rules of the Department of Public Works.
SECTION 2. Section 20-46(c), Chapter 20, Article 4 of the Hawaii County Code is
amended as follows:
"(c) Administrative rules [may] shall provide partial credit to commercial haulers for
residential waste. The amount of the credit shall be no les~,lh~n two dollars per
month for each household from which the hauler collects refuse."
SECTION 3. Material to be repealed is bracketed. New material is underscored. In
printing this ordinance, the brackets, bracketed material and underscoring need not be included.
SECTION 4. This ordinance shall take effect upon its approval.
