Dear Chairman Arakaki:
The Big Island Business CounCll rcpresentJng twelve business organizations on the 6Ig Island wishes to
convey our support of Resolution 10497 calling for a special session of tfse State Legislature to deal
with prlvatlzaUon as it has been impacted by the Supreme Court's decision In "Kovno v Counq of
Hawaii".
This decis(on has created a cloud of doubt between our neighbor Island counties and the private
businesses who contract with the counties for services.
The issue must be settled through the Ieglslatlve process and we are disappointed chat our State
Legislator's did not successfully address the problem during [he jus[ completed regular session.
The SUte of Hawaii is already reeling from economic slowdowns and the continued aura o(a State
that is unfriendly to business activity. This Inac[ivity by our State Leglsiaton contribu[es to that
unfriendly atdulde anA needs to be addressed.
