Comm. 1100: ORDINANCE BILL AMENDING CHAPTER 25 OF THE HAWAII
(Bill 250) COUNTY CODE RELATING TO REVISIONS TO THE ZONING CODE
From Mayor Stephen K. Yamashiro, dated March 29, 1996,
transmitting a letter and the above bill from Planning
Commission Chairman Kevin M. Baloq.
Comm. 342.03: From David and Miriama Thompson, dated July 3, 1995,
expressing their opposition to any changes in the
existing Zoning Code that will allow all existing
illegal Bed and Breakfast (B&B) businesses presently
operating to become legal and states that permits
should be issued or denied on an individual basis.
Comm. 601: From Dee and Bob Dwyer, dated July 16, 1995, objecti~iy
to the proposed zoning code revision concerning Bed and
Breakfast regulations. They state the affected
community in the neighborhood of any proposed B&B
should have the influence to say whether a B&B should
be allowed in their area.
Comm. 601.01: Copy of letter to the Planning Commission, from John
Franklin and Marian Johnson, stating that they are
against the proposed changes to Bed and Breakfast
establishments, that B&B's should be eliminated as an
allowable use in RS zoning.

Comm. 601.02: Copy of letter to the Planning Commission, from
Janice M. Mahuna, dated August 9, 1995, opposing the
proposed changes to the ezisting Bed & Breakfast
Ordinance 92-104. She would like B&B's completely
banned from operating in residential neighborhoods.
Comm. 601.03: From Alice S. Waki, dated August 28, 1995, opposing the
proposed change in the present bed and breakfast zoning
regulation.
Comm. 407.01: From Councilman John Ray, dated May 24, 1995,
transmitting a letter from John Broussard, dated
May 24, 1995, which states his first impression of tb.e
Zoning Code Revision draft is that it's a poorly
prepared, developer-oriented revision of an ezisting
code which is itself outdated and in need of major
objective changes.
Comm. 534: From Michael J. Matsukawa, Attorney at Law, dated
June 27, 1995, commenting on the draft proposal to
revise the Zoning Code. States the proposal, in
substance, does not introduce any major new ideas and
merely serves to do "housekeeping". Submits
suggestions on the matter.
Comm. 978: Copy of letter to the Planning Commission, from John A.
Broussard, dated February 4, 1996, stating that the
Commission was acting illegally by considering new
zoning code revisions which had been neither advertised
nor made available in advance of the meetings, in
violation of the Sunshine law. Suggests that the Ma}•or
and Council comply with the Sunshine law, and to avoid
litigation that any matters transmitted by the
Commission which involve or include revisions 2/1/96 be
returned to that body in full conformity with
Chapter 92 of the Hawaii Revised Statutes.
Comm. 1100.O1:From John Hartman of H.A.W.K., dated April 4, 1996,
transmitting documentation from the Hawaii State
Commissions on Persons with Disabilities, Dinmore &
Cisco Architects, Inc., Virginia Macdonald AIA, the
Hawaii Chapter of Hawaii Society of Professional
Engineers, the Keauhou Beach Hotel, the Keauhou
Shopping Center, Maryl Development, the Centers for
Independent Living, Community and Developmental
Disabilities Council, Hawaii County Mayor's Committee
on Persons with Disabilities, the Protection and
Advocacy Agency of Hawaii, A.B.L.E.D., and Disability
Rights-Hawaii, regarding the proposed requirements for
accessible parking to the Revised Zoning Code.

Comm. 1100.02:From Robert E. Oliver, III, AIA, Architect and
President, AIA Hawaii Island Section, dated April 8,
1996, in behalf of his constituents, recommends the
approval of the proposed requirements for Accessible
Parking Design to be incorporated into the Revised
Zoning Code.
Comm. 1100.03:From Planning Commission Chairman Kevin M. Balog, dated
April 10, 1996, informing that at the Commission's
public hearing on February 2, 1996, Section 25-5-32
(Permitted Uses) of Division 3.RM, Multiple-Family
Residential Districts of the Draft Zoning Code
document, was added to read as follows:
j22) Time share units and time share plans in
areas designated resort by the General Plan
LUPAG Mao or in areas identified as resort
areas by the General Plan Land Use Element.
Comm. 1100.04:From Helen Young, Chairperson, State Commission on
Persons with Disabilities, dated April 9, 1996,
submitting the commission's recommendations amending
the Land Use Ordinance relating to accessibility for
persons with disabilities through Bill 250, as listed.
Attaches copy of Americans with Disabilities Act (ADA)
accessible parking requirements.
UNFINISHED BUSINESS
Comm. 533: PROPOSED REVISIONS TO ZONING AND SUBDIVISION CODES
From Councilmember Keola Childs, dated June 13, 1995,
requesting that a special sub-committee be appointed
for the purpose of reviewing and assessing the proposed
revisions to the Zoning and Subdivision Codes.
Envisions this special sub-committee to need
approzimately siz months to complete its review and
provide recommendations on the Zoning Code, while the
review of the Subdivision Code should take perhaps two
to three months.
Comm. 846: COMMUNICATION FROM KLAUS D. CONVENTZ RELATING TO
~Finanrx nND OPEN SPACE REGULATIONS
From Councilman Keola Childs, dated November 17, 1995,
transmitting the above communication for discussion.
Comm. 846.01: From Chief Engineer Donna Fay K. Kiyosaki, dated
January 25, 1996, stating in response to a request fc~r
comments on Comm. 846, that discrepancies among the
various codes, as listed, will be addressed when the

Comm. 846.01: Zoning Code is revised. Much of the "confusion" is
(Cont'd) caused by the Housing Code because there are instances
when it governs over the Zoning Code.
Comm. 846.02: From Planning Director Virginia Goldstein, dated
March 4, 1996, providing comments to Klaus D.
Conventz's letter of November 10, 1995 relating to
setback and open space regulations.
