PC-30 Paqe 2 April 2, 1996 Comm. 1059: ORDINANCE BILL AMENDING CHAPTER 25 (ZONING CODE) OF (Bill 235) THE HAWAII COUNTY CODE, AS AMENDED, RELATING TO THE EXCAVATION OF CINDER CONES From Councilman Keola Childs, dated March 6, 1996, transmitting the above bill, which purpose is to preserve and protect those cinder cones which hold substantial historical and environmental value to the County of Hawaii. Comm. 963: PRESERVATION OF CINDER CONES FOR THE A'O BIRD (Unfinished From Athena Peanut, Friends of the Red Road, dated Business) January 25, 1996, informing of the need to preserve the cinder cones in the Puna district for the nesting and breeding of the A'o bird, which is on both federal and state endangered lists. States permits to mine the cinder cones are routinely given by the Planning Department without any consideration to the consequences for the flora and fauna and wishes to call the Council's attention to the urgency of recognizing the status of these cones and craters. UNFINISHED BUSINESS Comm. 968.01: COMMUNICATION NO. 968 FROM HENRY ROSS REGARDING ORDINANCES 96-8 AND 99-73 - OCEANSIDE 1250 - KONA From Council Chair Keiko Bonk-Abramson, dated February 5, 1996, requesting the above communication be discussed. Comm. 968.02: From Corporation Counsel Richard D. Wurdeman, dated March 4, 1996, informing, in response to a request for comments on Comm. 968.01, that he has no comment as to Mr. Ross' alleged legal issues raised. States Ordinance 94-73 has been upheld, except for one minor portion, by Judge Ronald Ibarra of the Third Circuit Court which, he is informed, an appeal has been taken. Until that matter is finally resolved, he feels comfortable in relying on Judge Ibarra's decision.
