Comm. 894: REVIEW OF WATER USE AND DEVELOPMENT PLAN
HAWAII COUNTY CODE - CHAPTER 29
From Water Commission Chairman Robert Meierdiercks,
Department of Water Supply Manager Milton D. Pavao,
and Planning Director Virginia Goldstein, dated
December 19, 1995, informing Section 29-4 of the Hawaii
County Code mandated a review of the County's Water Use
and Development Plan which should have been done by
1995 with proposed amendments submitted to the Council
by December 31st. Proposed changes were submitted to
the Commission on Water Resource Management (CWRM) for
review in 1992 but due to budget constraints their
review has been delayed. CWRM will be submitting their
review and comments and suggested changes shortly but
not in time for presentation to the Council.
Informs that the Water Commission, the designated
review committee, has no proposed amendments to present
to the Council at this time. However, depending on the
extent of CWRM's comments and suggestions, they plan to
comply with the County Code mandate as soon as possible.

Comm. 748: KONA PARADISE PROPERTY OWNERS ASSOCIATION
CONSOLIDATION AND RESUBDIVISION
From Corporation Counsel Richard D. Wurdeman, dated
October 9, 1995, responding to an inquiry by the
Council Chair of whether to seek a reversal of the
stipulated settlement and order filed on September 11,
1990, in Kona Paradise Property Owners Association,
et al. v. Paradise Incorporated, et al., Civil
No. 87-479. Informs a reversal need not and should not
be sought because the County was not ordered by the
court to grant the parties the consolidation and
resubdivision that they seek.
Comm. 748.02: From Corporation Counsel Richard D. Wurdeman, dated
November 22, 1995, submitting an opinion, as requested,
as to whether the Planning Director had the authority
to approve the resubdivision of the Kona Paradise
Subdivision and whether she appropriately exercised
that authority.
Comm. 748.03: From Council Chairwoman Keiko Bonk-Abramson, requesting
that Comm. 748.02 be agendized for the January 16, 1996
Planning Committee meeting.
