HomeMy WebLinkAboutRES 022 Draft 01 2004-2006 MtY OF N1 .•'~i\ G ~ ~ • ~ W~• G COUNTY OF HAWAII ~ STATE OF HAWAI I ;,F a.•~ RESOLUTION NO. 22 04 RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF HEALTH, DISABILITY AND COMMUNICATION ACCESS BOARD, PURSUANT TO HRS 46-7, TO IMPLEMENT THE STATEWIDE PROGRAM ON PARKING FOR PERSONS WITH DISABILITIES WHEREAS, the State of Hawaii Department of Health, Disability and Communication Access Board (DCAB) has authorized the funding towards the County of Hawai`i's Disabled Persons Parking Placard Program; and WHEREAS, these funds are part of the appropriation made by the 2004 State Legislature to compensate the counties for issuing parking placards for persons with disabilities; and WHEREAS, the funds will be used by the County to issue parking placards and identification cards to qualified persons with disabilities; to obtain and maintain computer hardware and software and Internet service to gain access to the parking permit database system; to ensure that designated staff are properly trained; to attend quarterly DCAB meetings, to adhere to the strict Parking Program's guidelines and rules; and to conduct periodic checks to ensure that placards are issued only to individuals who present the required documentation; and WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. NOW, T6~EREFORE, BE IT RESOLVED ~Y THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the County of Hawaii is authorized to execute, on behalf of the County, a Memorandum of Agreement, attached hereto and incorporated herein by reference as Exhibit "A", to enable the County to implement the Statewide Program on Parking for Persons with Disabilities. ~E IT FURTHER RESOLVE® that the County Clerk of the County of Hawaii shall transmit copies of this resolution to the Office of the Mayor and the Department of Finance. MEMORANDUM OF AGREEMENT between the STATE OF HAWAII DEPARTMENT OF HEALTH DISABILITY AND COMMUNICATION ACCESS BOARD and the COUNTY OF HAWAII OFFICE OF THE MAYOR This Agreement is made this day ~ ""°t~~~ 2004, by and between the Disability and Communicati.bn Access Board, Department of Health, State of Hawaii, hereinafter referred to as "DCAB" and the Office of the Mayor, County of Hawaii, hereinafter referred to as "COUNTY", to implement the Statewide Program on Parking for Persons with Disabilities, herein after referred to as "PARKING PROGRAM", which issues parking permits (placards and special license plates) and identification cards to qualified persons with disabilities. 1. Period of Agreement: Upon the approval by the Director of the Department of Health and the Ma or of the COUNTY, this agreement shall be effective from ~S LCU~r and shall continue through June 30, 2005, nless this Agreement is extended or sooner terminated as herein after provided. 2. Modification of Agreement: Unless terminated, this Agreement may be extended for not more than two (2) additional twelve- month periods upon mutual consent of the parties in writing at least thirty (30) days prior to expiration of this Agreement. 3. Termination of Agreement: This Agreement may be terminated only upon mutual consent of the Executive Director of the DCAB and the Mayor of the COUNTY. Either party may terminate the Agreement, but only after sixty (60) days written notice of such intention is received by the other party. 4. Responsibilities of the COUNTY: A. The COUNTY shall issue parking placards and identification cards to qualified persons with disabilities. B. The COUNTY shall obtain and maintain computer hardware and software and Internet service at the expense of the COUNTY to gain access to the parking permit database system. C. The COUNTY shall ensure that staff assigned to issue permits and input applicant information into the parking permit database will receive training approved and conducted by DCAB on the pertinent requirements of Title EXHIBIT "A" 11, Chapter 219, Hawaii Administrative Rules and on the proper use of the database system. D. The COUNTY shall ensure that only staff who have completed satisfactory training shall be authorized to issue placards and input information into the database system. E. The COUNTY shall input all application and transaction information into the database system within forty-eight (48) hours or two (2) working days from the date of receipt. F. The COUNTY shall attend at the expense of the COUNTY (excluding airfare), quarterly meetings at the DCAB office on Oahu. G. The COUNTY shall administer the PARKING PROGRAM in strict adherence to Chapter 291, Part III, Hawaii Revised Statutes and Title 11, Chapter 219, Hawaii Administrative Rules. H. The COUNTY shall conduct periodic checks to ensure that permits are issued only to individuals who present the required documentation. The COUNTY shall take appropriate corrective action in the case where issuance procedures are not strictly followed. I. The COUNTY shall ensure that the placards and expiration decals are stored securely at all issuance stations to protect them from loss, damage, or theft. 5. Responsibilities of the DCAB: A. The DCAB shall establish and maintain a parking permit database system in the DCAB office on Oahu. The database shall be accessible to the COUNTY via high- speed Internet connection. B. The DCAB shall provide approved training on the proper use of the parking permit database system to each staff person of the COUNTY assigned to entering parking permit application information onto the database. C. The DCAB shall provide parking permit database system user manuals to the COUNTY. D. The DCAB shall provide ongoing, trouble-shooting technical assistance to the COUNTY via telephone, facsimile, or email with respect to the parking permit database system. E. The DCAB shall provide identification cards or computer template to the COUNTY. F. The DCAB shall provide parking placards and expiration decals to the COUNTY as needed. 6. Compensation and Payment Schedule: For services performed by the COUNTY under this Agreement, the DCAB shall transfer a total sum of money not to exceed eighteen thousand four hundred twenty and no/100 ($18,420) of state funds.
