RESOLUTION AUTHORIZING A GRANT OF EASEMENT FOR RETAINING WALL PURPOSES
AT THE KONA PALISADES SUBDIVISION, UNIT I, KALAOA 5TH, DISTRICT OF NORTH
KONA, COUNTY AND STATE OF HAWAII, PORTION OF IMO PLACE FRONTING TAX MAP
KEY: (3)7-3-031:046, TO ABUTTTING LANDOWNERS FRANCES RAE McCLURE, TRUSTEE,
AND JOHN Q. McCLURE, JR.
BE IT RESOLVED BY THE COUNTY COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, the County of Hawaii ("County") is the owner of that certain roadway
right-of--way located in the Kona Palisades Subdivision, Unit I, Kalaoa 5th, District of North Kona,
County and State of Hawaii, fronting Tax Map Key: (3)7-3-031:046, known as 73-4327 Imo Place (see
Exhibit "A"); and
WHEREAS, Frances Rae McClure, Trustee, and John Q. McClure, Jr. ("McClures"), are the
owners of Tax Map Key: (3)7-3-031:046, known as 73-4327 Imo Place, abutting the Imo Street County
right-of--way; and
WHEREAS, the retaining wall owned by the McClures runs along the northeast section of Imo
Place and encroaches into the County's right-of--way; and
WHEREAS, the retaining wall was built by the previous owners, Richard and Cynthia-Bell
Petersen; and
WHEREAS, the retaining wall appeazs to have been built to retain the up-slope property,
73-4327 Imo Place; and
WHEREAS, the Department of Public Works has no objections to the granting of the easement
on the following conditions:
1. The McClures shall indemnify, defend and hold the County harmless from and
against all claims and demands for loss or damage, including property damage,
personal injury and wrongful death, arising out of or in connection with the uses of
said easement area by any person or persons, or any accident on said easement area or
any nuisance made or suffered thereon, or any failure by the McClures to keep said
easement area or the immediately adjacent area in a safe condition, and will
reimburse the County for all costs and expenses, including reasonable attorneys' fees,
incurred in connection with the defense of any such claims; provided, however, that
this indemnity shall not extend to or cover any loss, claim or demand suffered as a
proximate result of the intentional or negligent act of the County or the County's
employees or agents.
2. The County shall have no obligation to repair or replace the retaining wall even if
damaged by the County.
3. Should the retaining wall interfere or obstruct any improvements being provided by
the County now or in the future, the McClures shall at their own costs and expenses,
temporarily or permanently move the retaining wall out of the County'sright-of--way.
WHEREAS, the requested easement is approximatelytwenty-eight (28) square feet and has
been appraised at $22.24 per square foot ($22.24 x 28 = $622.72), rounded off to SIX HUNDRED
TWENTY-FIVE DOLLARS ($625.00) (see Exhibit "B"); and
WHEREAS, Section 2-111, Hawaii County Code, authorizes the Council, by resolution
approved by a majority of its members, to direct the Director of Finance to grant easements, subject,
however, to reversion to the County upon termination or abandonment of the easement for the specified
purpose for which the easement is granted.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with Section 2-111, Hawaii County Code, that it hereby authorizes the
Director of Finance to grant an easement for the encroachment of said retaining wall to Frances Rae
McClure, Trustee, and John Q. McClure, Jr., their heirs, devisees, personal representatives, successors
and assigns, as described in Exhibit "A" attached hereto, until termination or abandonment of that
specific purpose under the following conditions:
1. Frances Rae McClure, Trustee, and John Q. McClure, Jr., their heirs, devisees, personal
representatives, successors and assigns shall hold harmless, and indemnify and defend
the County of Hawaii, its officers, employees and agents, against any suits, claims,
demands, judgements, liens or costs arising from the placement of the retaining wall
within the County's right-of--way.
2. The County of Hawaii shall have no obligation to repair or replace the retaining wall
even if damaged by the County of Hawaii.
3. Should the retaining wall interfere or obstruct any improvements being provided by the
County of Hawaii now or in the future, Frances Rae McClure, Trustee, and John Q.
McClure, Jr., their heirs, devisees, personal representatives, successors and assigns,
shall at their own costs and expenses, temporarily or permanently move the retaining
wall out of the County's right-of--way.
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to: (1) Frances Rae
McClure, Trustee, and John Q. McClure, Jr., P.O. Box 229, Captain Cook, Hawaii 96704-0229;
(2) William Takaba, Director of Finance; (3) Bruce McClure, Director of Public Works; and (4) Craig T.
Masuda, Deputy Corporation Counsel.

Dear Mr. Norwood:
At your request we completed an appraisal of the raw site of the above referenced property The
estimated unencumbered fee simple value, free of any site improvements or existing encroachments is
estimated at $225,000 ox $22.24/sf (excluding area encroached upon).
The subject rock wall encroaches into the county right of way The county has agreed to an easement
within its right of way. The appraisal values the area as a complete taking since the exclusive use of the area
will belong to the subject after the easement. However, the amount of area the subject will increase by after the
taking is not considered sigrdficant enough to change the value or marketability of the subject site. The value
of the portion taken is estimated to command a similar per sq.ft. value as the subject site before the taking.
The total area under the encroachment is 28 square feet. The value estimated per square foot is $22.24/sf x 28
sq. ft. _ $625(rounded). Therefore, the estimated value of the land area under the subject rock wall within the
county right of way is $625.00. Trust the forgoing outlines out position with respect to the value of
encroachment area.

SCOPE AND PURPOSE
